NOTICE OF SALE UNDER POWER GEORGIA, Fannin COUNTY THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in that certain Security Deed given by William Michael Stout aka William Michael Stout, II to United Community Bank, dated 11/29/2010 and filed 12/07/2010, recorded in Deed Book 949, Pages 677-685, Fannin County, Georgia Records, (later assigned to First Southwestern Financial Services, LLC) conveying the after-described property to secure a Promissory Note in the original principal amount of Seven Hundred Twenty Two Thousand One Hundred Ten Dollars and Eighty Three Cents($722,110.83) (given by Southern White Wood Products, Inc., guaranteed by William Michael Stout, II and Ray Lynn Golden) ,Later renewed with a new Promissory Note in the real amount of $297,576.65 (given by Southern White Wood Products, Inc., guaranteed by Ray Golden) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Fannin County, Georgia, within the legal hours of sale on Tuesday April 4, 2017, the following described property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOTS 117, 135 AND 136, OF THE 8TH DISTRICT AND 1ST SECTION OF FANNIN COUNTY, GEORGIA, AND BEING MORE PARTICULARLY DESCRIBED AS LOT 8 OF "THE ENCLAVE AT WINDING BROOK", CONTAINING 1.52 ACRES OF LAND, AS SHOWN ON A PLAT OF SURVEY PREPARED BY JOEL JORDAN, G.R.L.S. NO. 2430, RECORDED IN PLAT HANGER E-78, PAGES 6-8, FANNIN COUNTY, GEORGIA RECORDS, WHICH PLAT BY REFERENCE THERETO SHALL BE FULLY INCORPORATED HEREIN AND MADE A PART HEREOF. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Promissory Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is William Michael Stout aka William Michael Stout, II and Gina Construction, LLC or a tenant or tenants and said property is more commonly known as Lot 8 of the Enclave at Winding Brook, Morganton GA 30560.
