NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF TURNER
By virtue of the power of sale contained in that certain Deed to Secure Debt from LAMAR RICHARDSON and BRENDA SUE RICHARDSON to WILLIAM P. K. ROCHFORT and SUSAN A. ROCHFORT, dated March 3, 1998 and recorded in Deed Book 153, pages 379-381, Turner County, Georgia Public Records, said Deed to Secure Debt having initially been given to secure a certain promissory note of even date therewith in the original principal amount of $38,500.00, with interest thereon as provided for therein together with any and all other indebtedness owing to William P. K. Rochfort and Susan A. Rochfort, there will be sold by the undersigned at public outcry, to the highest bidder for cash, before the courthouse door at Turner County, Georgia, within the legal hours of sale on the first Tuesday in April, 2017, the following described
property:
All that tract or parcel of land together with all improvements thereon situate, lying and being in the City of Ashburn, Turner County, Georgia, and being known as Lot Nos. 4 and 16 in Block 46 in the said City, said property fronting east 150 feet on Railroad Street and running back an even width west to Lawrence Street, and being bounded on the north by lands of now or formerly of J. H. Baxter, on the east by the right of way of G. S. & F. Railway, on the south by lands now of or formerly of Joe Lawrence, and on the west by Lawrence Street,
this being the same property conveyed to Mrs. Estelle Hay by Joe Mac Hancock under Warranty Deed dated
February 18, 1941, and recorded in Deed Book 23, Page 403, in the Office of the Clerk of the Turner Superior Court.
LESS AND EXCEPT:
All that tract or parcel of land lying and being in Block 46 in the City of Ashburn, Turner County, Georgia, and being more particularly described as follows: Begin at the southeast corner of Lot 4 in Block 46; from said point then travel in a southwesterly direction along a line which is the southerly boundary line of Lots 4 and 16 in Block 46 for a distance of 250 feet to a point; from said point then travel in a northwesterly direction parallel with the westerly boundary line of Lot 4 in Block 46 for a distance of 150 feet to a point on a line which is northerly boundary line of Lots 4 and 16 in Block 46; from said point then travel in a northeasterly direction along a line which is the northerly boundary line of Lots 4 and 16 in Block 46 for a distance of 250 feet to the northeast corner of Lot 4 in Block 46; from said point then travel in a southeasterly direction along the easterly line of Lot 4 in Block 46 for a distance of 150 feet and back to the point of beginning. The above described property measures 250 feet on the northerly and southerly sides and 150 feet on the easterly and westerly sides, said property fronting 150 feet on Railroad Street and running back an even width west 250 feet. Being a portion of that certain tract of land conveyed to William P. K. Rochfort and Susan A. Rochfort by warranty
deed dated 5-5-95 and recorded 5-8-95 in Deed Book 139, Page 571, Turner County, Georgia, Public Records.
ALSO:
A Destiny 70' x 28' double wide mobile home, Serial No. 045834AB, Model No. 703-46P, located on the
above described real estate and being a part of and attached to said real estate.
This conveyance is expressly subject to all outstanding easements and zoning ordinances of record.
The indebtedness secured by the aforementioned Deed to Secure Debt has been, and is hereby declared due because of default under the terms of said note and Deed to Secure Debt, including but not limited to, the nonpayment of the indebtedness as and when due. The indebtedness remaining in default, this sale will be made for the purpose of paying such indebtedness, all expenses of the sale, including attorney's fees (notice of intention to collect attorney's fees has been given), and all other payments provided for under the terms of the Deed to Secure Debt and note; and the remainder, if any, shall be applied as provided by law. Said property will be sold subject to the following items which may affect the title to said property: all zoning ordinances; matters which would be disclosed by an accurate surveyor by an inspection of the property; any outstanding taxes, including but not limited to advalorem taxes, which will constitute liens upon said property, all restrictive
covenants, easements, rights of way, and other matters of record superior to said Deed to Secure Debt. To the
best of the knowledge and belief of the undersigned, the parties in possession of the property are Lamar
Richardson and Brenda Sue Richardson or a tenant(s), and said property is more commonly known as 611
LAWRENCE STREET, ASHBURN, GA 31714.
