STATE OF GEORGIA COUNTY OF Richmond NOTICE OF SALE UNDER POWER Pursuant to the power of sale contained in the Security Deed executed by CURTIS EUGENE RAMSEY, DECEASED to BANK OF AMERICA, N.A., in the original principal amount of $160,500.00 dated April 26, 2010 and recorded in Deed Book 1258, Page1568, Richmond County records, said Security Deed being last transferred to BANK OF AMERICA, N.A. in Deed Book 1557, Page 2198, Richmond County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on April 04, 2017, the property in said Security Deed and described as follows: THE FOLLOWING DESCRIBED PROPERTY LOCATED IN RICHMOND COUNTY, GEORGIA: ALL THAT TRACT OR PARCEL OF LAND, WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN RICHMOND COUNTY, GEORGIA, KNOWN AND DESIGNATED AS LOT 2, BLOCK A, ON A PLAT OF LENNOX PARK SUBDIVISION, PREPARED BY BILLY B. BEAZLEY, RECORDED IN THE CLERKS OFFICE OF THE RICHMOND SUPERIOR COURT IN REALTY BOOK 33-O, PAGES 215- 216. REFERENCE BEING MADE TO SAID PLAT FOR A MORE ACCURATE DESCRIPTION AS TO THE METES, BOUNDS AND DIMENSIONS OF THE PROPERTY HEREIN CONVEYED. SAID PROPERTY FRONTS A DISTANCE OF 83.0 FEET ON THE EAST SIDE OF LENNOX ROAD AND EXTENDS BACK. THEREFROM BETWEEN PARALLEL LINES A DISTANCE OF 175.0 FEET ON ITS NORTHERN AND SOUTHERN BOUNDARIES TO A REAR WIDTH OF 83.0 FEET. SAID PROPERTY IS BOUNDED: ON THE NORTH BY LOT 1 OF SAID BLOCK AND PLAT; ON THE EAST BY PROPERTY NOW OR FORMERLY OF WILLIAMS; ON THE SOUTH BY LOT 3 OF SAID BLOCK AND PLAT; AND ON THE WEST BY LENNOX ROAD. SAID PROPERTY IS CONVEYED SUBJECT TO RESTRICTIVE COVENANTS APPLICABLE TO SAID SUBDIVISION AS THE SAME APPEAR OF RECORD IN SAID CLERKS OFFICE IN REALTY BOOK 33-P, PAGES 786-790. SAID PROPERTY IS CONVEYED SUBJECT TO A 20 FOOT DRAINAGE AND UTILITY EASEMENT WHICH EXTENDS EQUAL DISTANCE ACROSS THE ENTIRE EASTERN BOUNDARY OF SAID LOT, AS MORE PARTICULARLY SHOWN BY REFERENCE TO THE AFOREMENTIONED SUBDIVISION PLAT. Said property being known as: 2429 LENNOX RD AUGUSTA , GA 30906 MAP/PARCEL: 131-0-049-00-0 To the best of the undersigned's knowledge, the party or parties in possession of said property is/are CURTIS EUGENE RAMSEY, DECEASED or tenant(s). The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. Said sale will be conducted subject to the following: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
