NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of a Power of Sale contained in that certain Security Deed from TOMMY MABUS to SECURITY FEDERAL BANK, dated February 26, 2009, and recorded March 10, 2009 in Deed Book 1209, Page 1193, Richmond County, Georgia Records, as modified by instruments dated March 29, 2010 and recorded in Deed Book 1255, page 654 and May 5, 2011 and recorded in Deed Book 1302, page 0011 in the aforesaid records, said Security Deed having been given to secure a Note dated May 5, 2011 in the original principal amount of Five Hundred Thousand and No/100 Dollars ($500,000.00), with interest thereon as provided for therein, there will be sold at public outcry to the highest bidder for cash at the Richmond County Courthouse, within the legal hours of sale on the first Tuesday in April, 2017, all property described in said Security Deed including but not limited to the following described property: ALL that lot or parcel of land with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, containing 16.76 acres, more or less, as shown on a plat dated November 26, 1990 prepared by John Harriss, Registered Land Surveyor and recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 356, Pages 885-886; reference being made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. LESS & EXCEPT, ALL that lot or parcel of land with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, and being shown and designated as Tract "A", 1.962 acres, more or less, on a plat dated July 12, 1996 prepared by Bill S. Hargrove, Land Surveyor of James G. Swift & Associates and recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia in PC "B", Slide 18, Plat "L", reference being made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. Said property is hereby conveyed subject to easements referenced in certain documents and deeds recorded in the aforesaid clerk's office in Realty Reel 44, beginning at page 898, Realty Reel 55, beginning at page 1176, Realty Reel 162, beginning at page 379, Realty Reel 175, at page 1191, Realty Reel 546, beginning at page 1625, Realty Book 10-D, at page 549 and in Realty Book 10-D, at page 574. Said property is hereby conveyed subject to any and all other easements and restrictions of record in the aforesaid Clerk's Office. Tax map &parcel number: 073-3-008-01-9 Said property being commonly known as 912 Molly Pond Road, Augusta, Georgia 30901. The indebtedness secured by said Security Deed has been and is hereby declared due because of default under the terms of said Security Deed and Note. This indebtedness remaining in default, this sale will be made for the purpose of paying the same, all expenses of the sale, including attorneys' fees (notice to collect same having been given) and all other payments provided for under the terms of the Security Deed and Note. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: any outstanding ad valorem tomes (including taxes which are a lien, whether or not now due and payable); the right of redemption of any taxing authority; matters which would be disclosed by an accurate survey or by an inspection of the property; all zoning ordinances; assessments; liens; encumbrances; restrictions; covenants, and any other matters of record superior to said Security Deed.
