gpn11 Foreclosures STATE OF GEORGIA COUNTY OF NEWTON NOTICE OF SALE UNDER POWER Because of a default under the terms of the Security Deed executed by Betty Davis Thomas and Raleigh Calhoun Thomas to LendMark Financial Services, Inc. dated April 9, 2009, and recorded in Deed Book 2710, Page 111, Newton County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Branch Banking and Trust Company, securing a Note in the original principal amount of $15,000.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, April 4, 2017, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that tract or parcel of land lying and being in Newton County, Georgia, and being Lot No. 13 of Oxford Road Subdivision according to Plat prepared by William H. Alexander, Jr., dated November 2, 1973, and being more particularly described as follows: BEGINNING on the South side of Oxford Road at a point where the eastern side of Keel Street intersects the southern right of way of Oxford Road, said beginning point being also the northwest corner of the lot herein conveyed; thence North 85 degrees 20 minutes East a distance of 119.0 feet to an iron pin stake; thence South 04 degrees 40 minutes East a distance of 200.1 feel to an iron pin stake; thence South 85 degrees 20 minutes West a distance of 119.0 feet to an iron pin stake; thence North 04 degrees 40 minutes West a distance of 200.1 feet to an iron pin stake and point of beginning and being bounded on the North by Oxford Road, on the West by Keel Street, on the South by Lot No. 17, and on the East by Lot No. 14. Said property is known as 191 Oxford Road, Oxford, GA 30054, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
