gpn14 BC Foreclosures STATE OF GEORGIA COUNTY OF BRYAN NOTICE OF SALE UNDER POWER Because of default in the payment of the indebtedness secured by that certain Security Deed given by LAURA M. FINDLEY ("Borrower") to FIRST BANK OF COASTAL GEORGIA ("Lender"), February 22, 2010, and recorded in Deed Book 916, Page 0100, Bryan County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of FIFTY-FIVE THOUSAND FIVE HUNDRED FOURTEEN AND 64/100 DOLLARS ($55,514.64), as the same may have been extended, renewed and modified, as well as other possible events of default, said Lender has declared the entire amount of the said indebtedness immediately due and payable and pursuant to the power of sale contained therein and will on the first Tuesday in March to wit: March 7, 2017, during the legal hours of sale at the Courthouse Door in Bryan County, Georgia, sell to the highest bidder for cash the property described in said Security Deed, to wit: All that certain lot, tract or parcel of land situate lying and being in Bryan County, Georgia, known as Lot 3 of Bryan Bulloch Estates upon a plat of survey prepared by William T. DeLoach, Sr., Surveyor, dated January 25, 1989, revised March 22, 1989, recorded in the Office of the Clerk of Superior Court of Bryan County, Georgia in Plat Slide 382, page 1. This is the same property conveyed to David A. Patrick by Warranty Deed dated February 9, 1993, recorded in Deed Book 10-N, page 72, in the aforesaid Clerk's Office. Said map and deed are incorporated herein by reference. Together with that certain housing unit which was formerly personalty but is now permanently annex and affixed to the above described land as a permanent improvement and all rights thereto appertaining. Each person attending the sale will be afforded an opportunity to bid on a competitive basis. The Lender has the right to bid at the sale and may be the purchaser of the property. Said Property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, the right of redemption of any taxing authority, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The property will be sold as the property of LINDA M. FINDLEY, which to the best of the undersigned's knowledge and belief is the party or parties in possession of the aforementioned property. All proceeds of the sale will be applied to the payment of said indebtedness, the expenses of said sale, including attorney's fees (notice of intent to collect attorney's fees having been given), all as provided in the Security Deed, and the undersigned will execute a Deed Under Power to the purchaser at the sale as provided for in said Security Deed. This sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
