gpn14 HS Foreclosures NOTICE OF SALE UNDER POWER IN SECURITY DEED STATE OF GEORGIA COUNTY OF LIBERTY On the 27th day of March, 2014 Delisa Espada, of Liberty County, Georgia, as Grantor, executed a Security Deed to Southeastern Bank, securing a promissory note of said date, said Security Deed having been recorded in the Office of the Clerk of Superior Court of Liberty County, Georgia in Deed Book 1815, Page 503. By virtue of the Power of Sale contained in said Security Deed, there will be sold, by the undersigned at Public Outcry to the highest bidder for cash before the courthouse door of Liberty County, Georgia, within the legal hours of sale on the First Tuesday in April, the same being April 4, 2017, the following property, to-wit: All that certain lot, tract or parcel of land situate, lying and being in the 1458th G. M. District of Liberty County, Georgia, and being in the City of Walthourville, being known and designated as Lot No. 5, Smiley Woods Subdivision, as shown and represented on that certain plat of survey made and prepared by Joe P. Davis, Georgia Registered Land Surveyor No. 1436, dated November 4, 1996, and being recorded in Plat Section K-83, Page 3, in the Office of the Clerk of Superior Court of Liberty County, Georgia, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said lot of land being bounded, now or formerly, as follows: Northeasterly by lands of Carrie Heights Subdivision; Southeasterly by Lot No. 4; Southwesterly by the right of way of Sheila Drive; and Northwesterly by Lot No. 6, all as shown on the above referred to plat of survey. This conveyance is made subject to that certain Deed to Secure Debt from Delisa Espada to Norwest Mortgage, Inc., dated November 7, 1991, in the principal amount of $65,550.00 nd recorded in Deed Book 779, Page 87-100, in the Office of the Clerk of Superior Court of Liberty County, Georgia. A default under the terms of said Deed to Secure Debt to Norwest Mortgage, Inc. shall be considered a default under the terms of the within Deed to Secure Debt. The debt secured by said Security Deed and Note has been and is hereby declared due because of nonpayment thereof. The debt remaining in default, this sale is being made for the purposes of paying the same and all expenses of this sale and the proceeds of said sale will be applied as provided in said Security Deed. To the best of the undersigned's knowledge and belief, said property will be sold as the property of Delisa Espada, subject to any outstanding ad valorem taxes, assessments and liens or interests superior to the Security Deed first set out above; all easements and/or restrictive covenants appearing in the record, if any; and any matters which might be disclosed by an accurate survey and inspection of the property and applicable zoning ordinances. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor. The undersigned will execute a Deed to the Purchaser at said sale, as provided in the aforesaid Security Deed. This the 2nd day of March, 2017.
