gpn14 HS Foreclosures NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF LIBERTY IN DEED TO SECURE DEBT On the 3rd day of June 2011, EDWARD N. BOWENS, ("Bowens") executed a Promissory Note ("Note") and Deed to Secure Debt ("Deed") for $166,842.00 payable to Walter Mortgage Company, LLC, conveying property described in Exhibit "A", All that certain tract or parcel of land situate, lying and being in the 15th, G.M. District of Liberty County, Georgia, containing 1.00 acre, more or less, and being bounded, now or formerly, as follows on the North by lands of Thomas Nells (Lot Number 4 of The Estate of Jack Anderson); On the East by lands of Mattie A. Denard; on the South by lands of Charles Anderson (Lot Number 2 of The Estate of Jack Anderson); and on the West by the right of way of U.S. Highway 17. Said lot is more fully described as being Parcel "A" on that certain plat prepared by C.E. Williams, R.L.S. Number 1565, dated October 19, 1982, and recorded in the Office of the Clerk of Superior Court, Liberty County, Georgia Plat Book 19, page 108. For further description of said property, reference is made to the aforesaid plat and record thereof. and recorded in the Office of the Clerk of Superior Court of Liberty County, Georgia, in Deed Book 01680, page 00326, both of which were subsequently assigned to Ditech Financial LLC, ("Ditech"), by assignment dated March 1, 2016, and recorded in aforesaid Clerk's Office in Deed Book 1897, pages 258-266. Default has been made in the payment of installments due for June 2016, and subsequent thereto. Ditech declared the entire unpaid indebtedness due and payable in accordance with the terms of said Note, and the same has not been paid. The Deed provides that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Liberty County, Georgia, upon Ditech first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the Sheriff's advertisements are published, and where said property is located. NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Liberty County, Georgia, at public outcry on the first Tuesday in April 2017, between the legal hours of sale. Ditech will convey title to the purchaser as attorney-in-fact for Bowens. The money derived from the sale will be applied: first to the expenses of said sale; secondly, to the amount due on said Note; and the balance, if any, shall be paid to Bowens. TERMS: Cash, subject to State and County ad valorem taxes or assessment and any federal tax liens of record. Purchaser is to pay for all legal papers and revenue stamps. This 4th day of April 2017.
