STATE OF GEORGIA COUNTY OF HART NOTICE TO FORECLOSE RIGHT OF REDEMPTION TO: Marikai Enterprises, Inc., all residents/tenants/occupants, all persons known and unknown who may claim an interest in the property described on the attached Exhibit "A" located in Hart County, Georgia. Take notice that pursuant to O.C.G.A Section 48-4-45 and 48-4-46, that this is "Notice" to those named above that their rights regarding Redemption of the tax sale deed to said property are being foreclosed and the right to redeem the following described property, to wit: See attached Exhibit "A", being known as Tax Map & Parcel C26E 037, Hart County, Ga. WILL EXPIRE AND BE FOREVER BARRED AND FORECLOSED FROM THE RIGHT OF REDEMPTION ON the 6th day of April, 2017. The tax deed to which this Notice related is dated the 1st day of March, 2016 and is recorded in Office of Clerk of the Superior Court of Hart County, Georgia in Deed Book 796, Pages 118-119. Said property may be redeemed at any time on or before the 6th day of April, 2017 by payment of the redemptive price fixed and provided by law, to the undersigned, at the following address, to wit: Jerry Caswell, Jr. c/o Todd C. EXHIBIT "A" All that tract or parcel of land, together with all improvements thereon, in the 1117th District, G.M., Hart County, Georgia, containing 2.58 acres, more or less, and being designated as TRACT 3 on a plat made by AM. Britt, Registered Land Surveyor, dated December 17, 1985, and recorded in Plat Book 2-C, at Page 279, Clerk's Office, Hart County, Georgia. Said plat together with its recordation is by reference incorporated herein in aid of this description. This tract of land is bounded now or formerly on the Northwest by the "W.A. Moore" lot; on the Northeast by the United States of America; on the Southeast by property of the United States of America; on the Southwest by Tract 4-A, hereinafter described, Cherokee Circle and the "Well Lot". ALSO, All that tract of land located in the 1117th District, G.M., Hart County, Georgia, containing 0.70 of an acre, more or less, and being designated as TRACT 4-A on a plat made by AM. Britt, Registered Land Surveyor, dated December 17, 1985, and recorded in Plat Book 2-C, at Page 279, Clerk's Office, Hart County, Georgia. Said plat together with its recordation is by reference incorporated herein in aid of this description. This tract is bounded now or formerly on the Northwest by Cherokee Circle; on the Northeast by Tract 3; on the Southeast by property of the United States of America; and on the Southwest by lot of W. Richard Cheshire, and is described as to courses and distances in the following manner: ALSO, All that tract of land located in the 1117th District, G.M., Hart County, Georgia, containing 4.20 acres, more or less, and being designated as TRACT 4 on a plat made by A.M. Britt, Registered Land Surveyor, dated December 17, 1985, and recorded in Plat Book 2-C, at Page 279, Clerk's Office, Hart County, Georgia. Said plat together with its recordation is by reference incorporated herein in aid of this description. This tract of land is bounded now or formerly on the Northeast by the lot of Ray McGinnis; on the Southeast by property the United States of America and Interstate Highway No. 85; on the Southwest by Interstate Highway No. 85; on the Northwest by Cherokee Circle and the "Well Lot and Easement" as shown on the above described plat. ALSO, All that tract or parcel of land lying and being in the 1117th District, G.M., Hart County, Georgia, containing eight (8) acres, more or less, and being bounded on the Northeast by Tract 2, now or formerly known as the Doscer lot, and lands of the United States of America; on the North, Northwest and Southwest by lands of the United States of America; on the Southwest by Lots 371,372 and 373 of Section Two of Tugaloo Bay Subdivision; and on the Southeast by Cherokee Circle. There is EXCEPTED FROM AND NOT INCLUDED IN THIS DESCRIPTION AND CONVEYANCE the subdivision road and cul-de-sac, the 0.11 acre lot, now or formerly owned by Robert W. Wingo, and the 0.20 acre Jot, now or formerly owned by Peggy Jo. Matthews. These exceptions are shown on the plat hereinafter described. This property is identified as TRACT 1 on a plat made by A.M. Britt, Registered Land Surveyor, dated December 17, 1985, and recorded in Plat Book 2-C, at Page 279, Clerk's Office, Hart County, Georgia, which said plat together with the recordation thereof is by reference incorporated herein in aid of this description. ALSO, All that tract of land located in the 1117th District, G.M., Hart County, Georgia, containing 4.46 acres, more or less, and being bounded on the Northwest by Cherokee Circle; on the Southwest, South and Southeast by Cherokee Circle; and on the Northeast by Lot Nos. 339, 340, 341 and 369 of Section Two of Tugaloo Bay Subdivision. This tract of land is identified as TRACT 5 on a plat dated December 17, 1985, made by A.M. Britt, Registered Land Surveyor, said plat is recorded in Plat Book 2-C at Page 279, Clerk's Office, Hart County, Georgia, which said plat together with the recordation thereof is by reference incorporated herein in aid of this description. ALSO, All that tract or parcel of land lying and being in the 1117th District, G.M., Hart County, Georgia, containing 0.24 of an acre, more or less, and being bounded substantially in the following manner: On the South by Cherokee Circle; on the Southwest by Tract 2 known as the Doster Lot; on the Northeast by property of the United States of America; on the Southeast by Tract 3 as shown on the following described plat. This property is more fully shown and delineated on a plat dated December 17, 1985, made by A.M. Britt, Registered Land Surveyor, recorded in Plat Book 2-C at Page 279, Clerk's Office, Hart County, Georgia, which plat together with its recordation is by reference incorporated herein in aid of this description. This lot is identified on said plat as the "W.A. Moore" lot. It is understood and agreed that the "W.A. Moore" lot shall be used for residential purposes only, and that no building shall be constructed with less than 1000 square feet of heated floor space area; there shall be no concrete block buildings; there shall be no concrete blocks visible above the ground level; there shall not be any mobile homes of any description; no tents or campers; no outdoor toilets and no old homes or parts moved onto the property. ALSO, conveyed herein is a perpetual easement to use Cherokee Circle and other subdivision streets for the purpose of ingress and egress from the above described properties to the county Road. The above tracts are the same property described in a Warranty Deed from Harbor Light Marina, Inc. To Marikai Enterprises, Inc. Dated December 27, 1985, recorded in Deed Book 179, at Page 265, Hart County, Georgia Records, and said Deed and the recordation thereof are by reference incorporated herein and made a part of this description.
