GB3-63171 Davis STATE OF GEORGIA COUNTY OF HARALSON On June 15, 2016 Bobby Charles Davis, Executor of the Estate of Effie Beatrice DeRosier, executed and delivered a Deed to Secure Debt to Sunbelt of Alabama, LLC, securing present and future indebtednesses or liabilities to said Sunbelt of Alabama, LLC, to include a note in the total principal amount of Eighty-Five Thousand and 00/100 Dollars ($85,000.00), said Deed to Secure Debt being of record at Deed Book 1152, Page 272, Clerk's Office, Haralson Superior Court. By virtue of the Power of Sale contained in said Deed to Secure Debt there will be sold by the undersigned at public outcry to the highest bidder, for cash, after proper advertisement, before the Courthouse door of Haralson County, Georgia, within the legal hours of sale on the first Tuesday in April, 2017, the same being April 4, 2017, the following described property, to-wit: TRACT ONE: TA11 0060 (Bankhead Hwy., Tallapoosa, GA 30176) All that tract or parcel of land lying and being in Land Lot No. 152 in the 8th District and 5th Section of Haralson County, Georgia, in the City of Tallapoosa, and more particularly described as follows, to wit: Subdivided Lots Nos. 15 and 16 in Block No. 51 of the Otto F. Feil property as per plat thereof made by L.H. Fitzpatrick, C.E. and E.L. Boggis, Surveyor, dated June, 1947, recorded in Plat Book 1A, pages 26 and 27, Haralson County Plat Records, which plat is by leave of reference incorporated into and made a part of this description. Said lots lie together and form one body and front 100 feet on Bankhead Highway, a/k/a U.S. Highway 78, and extend back of equal width to Lot No. 19 of said Block; the West side of said tract being 166 feet in length and the East line being 162.9 feet in length. The Southeast corner of said tract is 100 feet West along the North right of way line of Bankhead Highway , a/k/a U.S. Highway 78, from the West side of unopened Nelson Place. Said property is identified by Map No. TA11 0060 by the Haralson County Board of Tax Assessors. The above described property being the same property as that described in that certain Executor's Deed Under Power from the Estate of Bobby Charles Davis, Sr. to Effie W. Davis dated May 12, 2006, and recorded in Deed Book 850, page 338, Haralson County Deed Records. TRACT TWO: TA11 0059 (42 W. Bankhead Hwy., Tallapoosa GA 30176) All that tract or parcel of land lying and being in Land Lot No. 152 in the 8th District and 5th Section of Haralson County, Georgia, in the City of Tallapoosa, and more particularly described as follows: Subdivided Lots Nos 13 and 14 in Block No. 51 of the Otto F. Feil property according to a plat thereof made by L.H. Fitzpatrick, C.E. and E.L.Boggis, Surveyor, dated June, 1947, and recorded in Plat Book 1-A, pages 26-27, in the office of the Clerk of the Superior Court of Haralson County, Georgia, and which plat is by leave of reference incorporated into and made a part of this description. Said property is located on the North side of U.S. Highway No. 78, a/k/a Bankhead Highway, in the City of Tallapoosa and having a building thereon known as the Dari Queen, or Dari King, together with other improvements. Said property is identified by Map No. TA11 0059 by the Haralson County Board of Tax Assessors. The above described property being the same property as that described in that certain Executor's Deed Under Power from the Estate of Bobby Charles Davis, Sr. to Effie W. Davis dated May 12, 2006, and recorded in Deed Book 850, page 339, Haralson County Deed Records. Effie Beatrice DeRosier being the one and same person as Effie W. Davis. A copy of this advertisement as presented to the publisher of this legal gazette has been sent by certified mail to the debtor at least 30 days prior to the date of the foreclosure sale, if this foreclosure is on the dwelling of the debtor at the time the Deed to Secure Debt was given, all in accordance with O.C.G.A. §44-14-162, et. seq. The note secured by said Deed to Secure Debt, as executed by Bobby Charles Davis, Executor of the Estate of Effie Beatrice DeRosier has been and is hereby declared due because of nonpayment thereof. This sale will be made for the purpose of paying the same and all expenses of this sale. The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Sunbelt of Alabama, LLC, P.O. Box 127, Ranburne Alabama 36273. Please be advised that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument. Said property will be sold as the property of Bobby Charles Davis, Executor of the Estate of Effie Beatrice DeRosier, (formerly known as Effie W. Davis) who is, to the best of the undersign's knowledge and belief, the party in possession thereof, and is more commonly known as that Bankhead Hwy., Tallapoosa, GA 30176 and 42 W. Bankhead Hwy., Tallapoosa GA 30176, and is subject to any outstanding ad valorem taxes and/or easements and/or restrictive covenants appearing of record, if any. The proceeds from said sale will be used first to pay the principal and interest due plus attorneys fees as prescribed therein and expenses of the sale, with the balance, if any, to Bobby Charles Davis, Executor of the Estate of Effie Beatrice DeRosier , his heirs and/or assigns. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U. S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed to Secure Debt.
