NOTICE OF SALE UNDER POWER THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. COUNTY OF BACON STATE OF GEORGIA By virtue of the Power of Sale contained in the Deed to Secure Debt from LARRY TIMOTHY CARTER to FNB South N.A., dated April 15, 1994 recorded in Deed Book 219, Pages 83-85, Clerk=s Office, Bacon County, Georgia, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Bacon County, Georgia, within the legal hours of sale on the first Tuesday in April, 2017, the following described property: All that tract or parcel of land lying and being 38.0 acres, more or less, in Land Lot 147 and 87.0 acres more or less, in Land Lot 148, both tracts of land lying and being in one body and both tracts being in the 5th Land District of Bacon County, Georgia, and being bounded as follows: On the North by run of Ten Mile Creek; East by lands of F. L. Carter, the original Land Lot Line dividing; on the South by Banner Carter; and on the West by lands of W. V. Carter, a certain Little Branch being the dividing line in part and an agreed line in part. LESS AND EXCEPT: All that tract or parcel of land lying and being 3.30 acres, more or less, in Land Lot 148, 5th Land District of Bacon County, Georgia, and being more particularly described on a plat prepared for Kandace Carter by Everett Tomberlin and Associates dated August 25, 2009, and recorded in Plat Cabinet A, Slide 361-1, in the Officer of the Clerk of Superior Court of Bacon County, Georgia. Said plat being incorporated herein by reference for all purposes. This tract being a portion of the land conveyed to Larry Timothy Carter from South Atlantic Production Credit Association f/k/a Douglas Production Credit Association by deed under power dated September 22, 1987, and recorded in Deed Book 167, Pages 146-147 in the Office of the Clerk of Superior Court of Bacon County, Georgia. Map and Parcel # Said Deed to Secure Debt having been given to secure notes dated April 15, 1994 in the original principal amount of $84,100.00 with interest from date at the rate as specified therein. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of among other possible events of default, failure to pay in accordance with the terms of said notes. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of the sale, including attorney=s fees. To the best of the undersigned=s knowledge, the party in possession of the subject property is: Larry Timothy Carter The above described property will be sold subject to unpaid state, county and city taxes to the highest bidder for cash and the proceeds will be applied to said indebtedness and the lawful expenses of said sale as provided in said security deed and a conveyance will be made to the purchaser at the sale as authorized by said security deed.
