NOTICE OF SALEUNDER POWER GEORGIA, COLQUITT COUNTY THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by EARL D. WILLIAMS to AMERICAN BANKING COMPANY dated April 27, 1994, recorded in Deed Book 501, Page 203, Colquitt County, Georgia Records, conveying the after-described property to secure a Note in the total amount of Forty-Two Thousand Nine Hundred Seventy-One Dollars and 83/100 ($42,971.83) with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Colquitt County, Georgia, within the legal hours of sale on the first Tuesday in April, 2017, the following described property: All that certain piece, parcel or tract of land situate, lying and being in the 8th Land District of Colquitt County, Georgia, and being 8.02 acres, more or less, of Land Lot 172, and more particularly described as follows: For the point of beginning of the tract herein described, begin at the original Northwest corner of said lot, and run South 2443.06 feet along the original West line of said lot to a point in the center of a public road; thence run along the center of said public road with the following calls: North 67 degrees 12 feet East 139.33 feet; North 84 degrees 26 feet East 116.22 feet; and South 87 degrees 30 feet East 162.0 feet to a point, which is the point or place of beginning of the tract herein described, and from said point of beginning run North 1 degree 53 feet 10 inches East 383.41 feet to a point in the run of a branch; thence run in a Northwesterly direction 606.85 feet along the run of said branch to a point; thence run South 85 degrees 06 feet 40 inches East 673.56 feet to a point; thence run South 4 degrees 54 feet 58 inches West 820.42 feet to a point in the center of said public road; thence run North 87 degrees 30 feet 00 inches West 299.08 feet along the center of said public road to the point or place of beginning. According to a plat of survey thereof prepared by Robert R. Jolley, Jr., Surveyor, dated December 21, 1979, and recorded in Plat Book 13, Page 95 in the office of the Clerk of Superior Court of Colquitt County, Georgia which said plat and the record thereof are by reference incorporated herein. Less and Except all that tract or parcel of land found at Deed Book 982, Page 509 - Rural Post Roads Right of Way. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in said Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is EARL D. WILLIAMS or a tenant or tenants. Pursuant to O. C. G. A. 44-14-162.2, the name, address and telephone number of the individual or entity who shall have the full authority to negotiate, amend, or modify all terms of the above described mortgage is as follows: AMERIS BANK, P.O. A.44-14-162.2 shall be construed to require AMERIS BANK to negotiate, amend or modify the terms of the Deed to Secure Debt described herein. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U S.
