NOTICE OF SALE UNDER POWER
GEORGIA, CHATTOOGA COUNTY
This is an attempt to collect a debt. Any information obtained will be used for that purpose.
Under and by virtue of the Power of Sale contained in a Security Deed given by Laurecia Bakken to Mortgage Electronic registration Systems inc as nominee for Novastar Mortgage, Inc , dated 08/31/2006, recorded in Deed Book 508, Page 557, Chattooga County, Georgia records, as last transferred to Deutsche Bank National Trust Company as Trustee for Novastar Mortgage Funding Trust, Series 2006-5 Novastar Home Equity Loan Asset-Backed Certificates, Series 2006-5 by assignment recorded or to be recorded in the Chattooga County, Georgia records conveying the after-described property to secure a Note in the original principal amount of Sixty Thousand and 00/100 Dollars ($60,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash at the usual place for conducting Sheriff's sales in Chattooga County, Georgia, within the legal hours of sale on the first Tuesday in April 2017, the following described property:
All that tract or parcel of land lying and being in Land Lot No. 147 in the 6th District and 4th Section of Chattooga County, Georgia, and being known and designated as Lot Nos. 7, 8, 9, 10, 33, 34, 35, 36, 37, and 38, and part of Lot Nos. 11, 12, 13 and 32, all in Block "E" of J.H. Henderson Subdivision, as shown on plat of record in Plat Book 1, Page 8, in the Office of the Clerk of the Superior Court of Chattooga County, Georgia, and being more particularly described as follows:
Beginning at an iron pin on the easterly right of way line, of Trion-LaFayette Public Road (formerly part of U. S. Highway No. 27 and sometimes known as "Old Hwy. 27", the right of way of which is 80 feet), which iron pin is 399.09 feet northeasterly, as measured along said side of said road form the northeast corner of its intersection with O`Neal street (also known as First Avenue, whose right of way is 40 feet wide), said beginning point being the southwest corner of the Elizabeth Jane Massey property; thence south 77 degrees 04 minutes 19 seconds east along the southerly line of said Massey property, a distance of 369.89 feet to a tree on the westerly side of an unopened street with a 40 feet wide right of way; thence south 15 degrees 57 minutes 13 seconds west along said westerly side of said unopened street, a distance of 161.67 feet to an iron pin corner; thence north 75 degrees 56 minutes 58 seconds west, a distance of 231.73 feet to a nail on the inner, or west side of a paved circular driveway; thence north 55 degrees 09 minutes 08 seconds west, a distance of 97.22 feet to a nail in the center of said paved driveway at the northwesterly end of said circular driveway; thence along the center of said driveway north 58 degrees 22 minutes 31 seconds west, a distance of 41.87 feet to nail marking the intersection of the center of said driveway with the easterly right of way line of said Trion-LaFayette Public Road; thence north 13 degrees 01 minute 48 seconds east along said easterly right of way line, a distance of 107.19 feet to a point, said point being point of beginning, containing 1.25 acres, more or less.
Together with an easement over the southerly half of said driveway with centerline of said easement extending form said easterly side of said public road south 58 degrees 22 minutes 31 seconds east, a distance of 41.87 feet to a nail marking the northwesterly end of said driveway becoming circular.
Being the same property conveyed to Laurecia Bakken, by warranty deed dated March 22, 2006, of record in Deed Book 496, Page 728, in the Chattooga County, Georgia records. Also, being the same property previously conveyed to Chester D. Clark, by warranty deed dated July 1, 2004, of record in Book 456, Page 243, in the office aforesaid.
Being the same property commonly known as: 2436 Old Highway 27, Trion, Georgia 30753.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Ocwen Loan Servicing, LLC, 1661 Worthington Road, Suite 100, West Palm Beach, FL 33409, 561-682-8000. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument.
To the best knowledge and belief of the undersigned, the parties in possession of the property are Laurecia Bakken or a tenant or tenants.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
