NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT
STATE OF GEORGIA
COUNTY OF CHATTOOGA
Whereas, heretofore on January 19, 2009, Kevin L. Minard and Rebecca L. Minard executed and delivered a certain Security Deed to Paul W. Tucker and Brenda Tucker for the purpose of securing indebtedness described therein, which Security Deed appears of record in Deed Book 556, page 423, in the Office of the Clerk of the Superior Court of Chattooga County, Georgia, reference to which deed is hereby made for its full terms, provisions and conditions.
Whereas, the debt secured by said Security Deed aforesaid has become in default as to the principal and interest and the holder thereof has declared the entire indebtedness at once immediately due and payable;
Now, therefore, pursuant to the terms, provisions and conditions of the aforesaid Security Deed and the laws in such cases made and provided, the undersigned will offer for sale and will sell for cash on the First Tuesday in April, to-wit: April 4, 2017, between the legal hours of sale at Public Outcry before the Courthouse Door in Summerville, Chattooga County, Georgia, the following described property:
All that tract or parcel of land lying and being in Land Lot 76 in the 14th District and 4th Section of Chattooga County, Georgia, and being a part of that property as shown on a plat captioned Survey for Kevin L. Minard & Rebecca L. Minard by Kenneth M. Reynolds dated December 15, 2008 and being recorded in the Office of the Clerk of the Superior Court of Chattooga County, Georgia in Plat Book 12, Page 133, reference to which plat is hereby made for a more specific description of said property; containing 0.537 acres, more or less.
Being a portion of the same property conveyed in multiple deeds recorded in Deed Book 471, Page 623-624; Deed Book 538, Page 411-412; and Deed Book 434, Page 197-198 in the Office of the Clerk of Superior Court, Chattooga County, Georgia.
Property known as 3638 Highway 100, Summerville, Georgia, 30747.
Said property will be sold subject to any unpaid taxes.
Said property will be sold at Public Outcry to the highest and best bidder for cash in bar of all equity of redemption; and will be sold as the property of Kevin L. Minard and Rebecca L. Minard, the maker of the aforesaid Security Deed, their heirs, administrators and assigns, and the said sale proceeds shall be used first for the payment of said note, principal, interest, expenses and attorney's fees and the balance, if any, distributed as provided under Georgia Law.
Paul W. Tucker and Brenda Tucker, 14950 SE 175th Street, Weirsdale, Georgia, 32195, shall have full authority to negotiate, amend and modify all terms of the mortgage with the debtors.
