NOTICE OF SALE UNDER POWER THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. COUNTY OF BACON STATE OF GEORGIA By virtue of the Power of Sale contained in the Deed to Secure Debt from LARRY V. CARTER to FNB South N.A., dated July 22, 1992 recorded in Deed Book 203, Pages 157-160, Clerk=s Office, Bacon County, Georgia, there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Bacon County, Georgia, within the legal hours of sale on the first Tuesday in April, 2017, the following described property: Tract One: All that tract or parcel of land lying and being 173.17 acres of Land Lot 147, Fifth Land District, Bacon County, Georgia, and being more particularly described on that certain plat of survey prepared by W. P. Copeland, Bacon County Surveyor, dated June 1, 1979 and recorded in Plat Book 7, Page 112, Bacon County records. This being the same land as Administrator of the estate of W.M. Carter, dated 2/2/43 and recorded in Deed Book 34, Page 266. LESS AND EXCEPT: 32.85 acres in Land Lot 147, Fifth Land District of Bacon County, Georgia and said property is more particularly described on a plat by W. P. Copeland, dated June 23, 1982, and recorded in Plat Book 7, Page 237, in the Clerk of Superior Courts Office, Bacon County, Georgia and said plat is incorporated herein by reference for all purposes. Tract Two: All that tract or parcel of land lying and being 133 acres, more or less, of Land Lot 130, 5th Land District of Bacon County, Georgia, bounded as follows: On the north by lands of John R. Harrison; on the east by the run of Gum Branch; on the south by lands of F. L. Carter and the run of Ten Mile Creek; on the west by lands, now or formerly, owned by W. M. Carter, and original land line. Tract Three: All that tract or parcel of land lying and being in the 5th Land District of originally Appling, now Bacon County, Georgia consisting of 63 acres, more or less, of Lot of Land 148 lying near the Northwest corner of said Lot; on East by lands of I.A. Carter, the dividing line being the edge of the bushes on the East side of a certain branch; on the South by lands formerly owned by Mrs. Mary E. Barber and now owned by a certain loan company; West by lands formerly owned by Mike Carter, and now owned by David Carter; the lands herein being known as the T. L. Carter place. Tract Four: All that tract or parcel of land lying and being 40 acres, more or less, of Lot of Land 147, 5th Land District of Bacon County, Georgia, being located in the Southwest portion of said Lot of Land, and described as follows: Beginning at a point approximately 196 yards East of the Southwest corner of said Lot of Land, where forked head branch crosses the South line of said Lot of Land; thence running the South line of said Lot of Land a distance of 510 yards, more or less, to a certain branch and to lands of I.A. Carter; thence running in a Northward direction along said branch to Ten Mile Creek; thence running West up Ten Mile Creek to a forked head branch ; thence following said forked head branch in a Southward direction back to original Lot Line or POINT OF BEGINNING. It is to be construed that the run of the branches and creek referred to shall be the line. Tract Five: All that tract or parcel of land lying and being 18 3/8 acres, more or less, in Land Lot 147 and also 16 3/8 acres in Land Lot 148, both Land Lots and Tracts being in the 5th Land District of Bacon County, Georgia, and both tracts lying and being in one body and bounded as follows: On the North lands of Joe Carter, the run of a branch being the dividing line; on the East by lands of W. V. Carter, formerly belonging to W. M. Carter; South by lands of G. A. Carter, formerly belonging to G. A. Carter; on the West by lands formerly dividing. LESS AND EXCEPT: All that tract or parcel of land lying in Land Lots 130 and 147 in the 5th Land District of Bacon County, Georgia, containing 107.70 acres and shown and described on a plat thereof prepared by Merlin J. Tomberlin, said plat being dated February 19, 1996 and being recorded in the Office of the Clerk of Bacon Superior Court in Plat Book___ Page ____. References made to said plat for all purposes of description and otherwise. Said Deed to Secure Debt having been given to secure notes dated July 22, 1992 in the original principal amount of $302,750.64 with interest from date at the rate as specified therein. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of among other possible events of default, failure to pay in accordance with the terms of said notes. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of the sale, including attorney=s fees. To the best of the undersigned=s knowledge, the party in possession of the subject property is: Larry V. Carter/Larry V. Carter Estate The above described property will be sold subject to unpaid state, county and city taxes to the highest bidder for cash and the proceeds will be applied to said indebtedness and the lawful expenses of said sale as provided in said security deed and a conveyance will be made to the purchaser at the sale as authorized by said security deed.
