STATE OF GEORGIA COUNTY OF FANNIN NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from ROBERT M THOMAS INVESTMENTS, LLLP to NANTAHALA BANK & TRUST COMPANY, dated December 19, 2008, recorded December 30, 2008, in Deed Book 870, Page 366, Fannin County, Georgia records, as last modified by Modification of Deed to Secure Debt dated April 26, 2011, recorded in Deed Book 968, Page 221, Fannin County, Georgia records, said Security Deed being given to secure a Note from ROBERT M THOMAS INVESTMENTS, LLLP dated January 4, 2013, as last modified by Debt Modification Agreement dated September 23, 2016, in the original principal amount of Eight Hundred Ninety Seven Thousand Four Hundred Twenty Five and 02/100 ($897,425.02) Dollars, with interest thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Fannin County, Georgia, within the legal hours of sale on the first Tuesday in March, 2017, the following described property: All that tract or parcel of land lying and being in the 8th District and 2nd Section of Fannin County, Georgia, and being in Land Lot Nos. 280, 297 and 298, and being more particularly described as 14.15 acres of land, as shown on that certain plat of survey dated August 4, 2005, prepared by Joel Jordan G.R.L.S. No. 2430, recorded in Plat Hanger D-227, Page 4, Fannin County Deed records. Said recorded plat is hereby made a part of this deed reference thereto for a more complete description of the above described property. The above described property is conveyed subject to all easements, restrictions and rights of way as set forth on said recorded plat or as appearing of record. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is ROBERT M THOMAS INVESTMENTS, LLLP or a tenant or tenants.
