Legal 44 STATE OF GEORGIA COUNTY OF PIKE NOTICE OF SALE UNDER POWER Under and by virtue of the Power of Sale contained in a Security Deed given by Reatha C. Watts to Mortgage Electronic Registrations Systems, Inc. as nominee for Ownit Mortgage Solutions, Inc., dated October 20, 2006, recorded on October 27, 2006 in Deed Book 675, Page 9-25 and later modified by Consent Order in Civil Action Number 2014V-0113 recorded on December 3, 2014 in Book 981 Page 307, Pike County, Georgia Records, said Security Deed having been last sold, assigned, transferred and conveyed to Alliance Realty Capital, LLC, the secured creditor, by Assignment conveying the after-described property to secure a Note in the original principal amount of One Hundred Eleven Thousand Five Hundred Ten and 00/100 ($111,510.00), with interest thereon as set forth therein, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on March 7, 2017 during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: Starting at the intersection of the East line of Land Lot No. 254 and the Southerly Right of Way of Watson Street; thence South 00 degrees 18 minutes 42 seconds East for 261.50 feet to the Point of Beginning. From said point of Beginning continue South 00 degrees 18 minutes 42 seconds East along the East line of Land Lot 254 for 217.00 feet; thence South 80 degrees 33 minutes 46 seconds West for 193.44 feet; thence North 05 degrees 12 minutes 28 seconds West for 217.00 feet; thence north 81 degrees 08 minutes 45 seconds East for 211.86 feet to the point of beginning. Said property being located in Land Lot No. 254 of the 9th Land District, City of Molena, Pike County, Georgia and containing 1.002 acres. Also, a perpetual easement for ingress and egress across the following described property: Starting at the intersection of the Easterly of Land Lot Number 254 and Southerly Right of Way of Watson Street, this being the point of beginning. From said Point of Beginning South 00 degrees 18 minutes 42 seconds East for 62.50 feet, thence continue along said East line of Land Lot No. 254, South 00 degrees 18 minutes 42 seconds East for 199.00 feet; thence South 81 degrees 08 minutes 45 seconds West for 30.34 feet; thence North 00 degrees 18 minutes 42 seconds West for 199.24 feet, thence North 00 degrees 18 minutes 42 seconds West for 82.94 feet to an extension of Watson Street; thence South 61 degrees 58 minutes 27 seconds East along said extension for 34.08 feet to a point on the East line of Land Lot No. 254 and the Point of beginning. Said 30 foot wide easement being described from an extension of Watson Street thru Parcel 1 and Parcel 2 as platted by William L. Morkes DWG, Number 2001-008 for Tiffany Payne, January 5, 2001 (“Tract 1 of 234 Watson Road”). Said property is known as 234 Watson Road, Molena, GA 30258, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold as the property of Reatha C. Watts, the property, to the best information, knowledge and belief of the undersigned, being presently in the possession of Reatha C. Watts or a tenant or tenants. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed. Pursuant to O.C.G.A. Section 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation of the audit of the status of the loan as provided immediately above. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including, without limitation, attorneys' fees. Notice has been given of intention to collect attorneys' fees and other charges in accordance with the terms of the Note secured by said Deed. The balance, if any, will be distributed as provided by law.
