NOTICE OF SALE UNDER POWER, Ben Hill County Pursuant to the Power of Sale contained in a Security Deed given by Robert Brown and Connie Brown to Mortgage Electronic Registration Systems, Inc. as nominee for First Guaranty Mortgage Corporation dated 9/18/2015 and recorded in Deed Book 878 Page 256 Ben Hill County, Georgia records; as last transferred to or acquired by First Guaranty Mortgage Corporation, conveying the after-described property to secure a Note in the original principal amount of $ 122,722.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Ben Hill County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on March 07, 2017 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: All of City Lots Numbers 14, 15, and 16 in Square Number 15, in Block Number 14 in the City of Fitzgerald formerly Irwin, now Ben Hill County, Georgia as shown by the plat of said made by or for the American Tribune Soldiers Colony Company of file in the office of the Clerk of the Superior Court of lrwin County, Georgia and being more particularly described as follows: COMMENCING at the point where the north right of way line of Roanoke Drive intersects the west right of way line of Lee Street and thence run due north along the west right of way line of Lee Street 40.00 feet to a point, being the point of beginning; thence run due west 170.83 feet to a point; thence run due north 120 feet to a point on the south right of way line of a 15 foot alley; thence run due east along the south right of way line of said 15 feet alley 170.83 feet to a point on the west right of way line of Lee Street; thence run due south along the west right of way line of Lee Street 120.00 feet to a point, being the point of beginning, as shown on plat of survey prepared by T. W. Ash, Georgia Registered Surveyor No. 2096, dated May 20, 1996 and recorded in Plat Slide 621-D, Public Records of Ben Hill County, Georgia. Said plat being made reference to and incorporated herein for a specific description of the above described property. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of in- tent to collect attorney's fees having been given). Said property is commonly known as 813 South Lee Street, Fitzgerald, GA 31750 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Robert Brown or tenant or tenants.
