STATE OF GEORGIA COUNTY OF FANNIN NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from FRANK D. HAMPTON to UNITED COMMUNITY BANK, dated November 8, 2004, recorded November 18, 2004, in Deed Book 605, Page 307, Fannin County, Georgia records, as modified by Modification of Security Deed dated January 31, 2015, recorded in Deed Book 1119, Page 206, Fannin County, Georgia records, said Security Deed being given to secure a Note from FRANKLIN D. HAMPTON dated January 31, 2015, in the original principal amount of One Hundred Thirty Seven Thousand Five Hundred Ninety Two and 55/100 ($137,592.55) Dollars, with interest due thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Fannin County, Georgia, within the legal hours of sale on the first Tuesday in February, 2017, the following described property: All that tract or parcel of land lying and being in the 8th District, 1st Section of Fannin County, Georgia and being a part of Land Lot No. 4 and being 2.00 acres according to a plat of survey prepared for Frank D. Hampton by Lane S. Bishop, G.R.L.S. No. 1575, dated June 19, 1995 and is recorded in Plat Book 29, Page 203, in the Office of the Clerk of Superior Court, Fannin County, Georgia. Reference is hereby made to said recorded plat for a more complete metes and bounds description of the property herein described. The Grantors reserve for themselves, their heirs, and assigns an easement for ingress and egress and utilities over the access road as shown on the above referenced plat of survey. Subject to existing easements and right of ways for public roads and utilities, if any. Subject to Fannin County, Georgia Subdivision Regulations and Mobile Home Regulations, if any. Also conveyed herewith is a non-exclusive right of ingress, egress and utility service along existing roads to the subject property. Being and intended to be that same property conveyed unto Frank D. Hampton from Danny Farmer and John E. Foster by Warranty Deed recorded July 28, 1995 in Deed Book 231, Page 147 in the Office of the Clerk of Superior Court, Fannin County, Georgia. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
