STATE OF GEORGIA COUNTY OF FANNIN NOTICE OF SALE UNDER POWER Under and by virtue of the power of sale contained in a Security Deed from MELINDA C. COLE N/K/A MELINDA C. WILSON to UNITED COMMUNITY BANK, dated August 14, 2008, recorded August 21, 2008, in Deed Book 857, Page 263, Fannin County, Georgia records, as last modified by Modification of Security Deed dated January 8, 2016, recorded in Deed Book 1154, Page 235, Fannin County, Georgia records, said Security Deed being given to secure a Note from MELINDA C. WILSON and JEFFREY LELAND WILSON dated January 8, 2016, in the original principal amount of Two Hundred Forty Four Thousand One Hundred Sixty Eight and 65/100 ($244,168.65) Dollars, with interest due thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Fannin County, Georgia, within the legal hours of sale on the first Tuesday in February, 2017, the following described property: TRACT ONE: All that tract or parcel of land lying and being in the 8th District, 2nd Section, Land Lot 248, containing 1.37 acres, more or less, as shown on a plat of survey by Shelly J. Bishop, G.R.L.S. #2536, Lane S. Bishop and Associates, dated January 2, 2002, and recorded in Fannin County Records in Plat Hanger C-386, Page 1, Fannin County Deed records. TRACT TWO:All that tract or parcel of land lying and being in the 8th District and 2nd Section of Fannin County, Georgia, being in Land Lot No. 248, containing 1.321 acres of land more or less, as shown on a plat of survey dated May 30, 2006, prepared by James L. Alexander, G.R.L.S. No. 2653, recorded in Plat Hanger D-333, Page 7, Fannin County Deed Records. Said recorded plat is hereby made a part of this deed by reference thereto for a more complete description of the above described property. LESS AND EXCEPT: All that tract or parcel of land lying and being in the 8th District and 2nd Section of Fannin County, Georgia, being in Land Lot No. 248, containing 1.24 acres of land, more or less, as shown on a plat of survey dated May 30, 2006, prepared by James L. Alexander, G.R.L.S. No. 2653, recorded in Plat Hanger D-396, Page 7, Fannin County Deed Records. Said recorded plat is hereby made a part of this deed by reference thereto for a more complete description of the above described property. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
