GEORGIA, FANNIN COUNTY NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT By virtue of the Power of Sale contained in a Deed to Secure Debt dated January 31, 2011, from Valerie Bell to Robert K. Condon and Nora Lee Condon, and recorded in Deed Book 957, pages 62-66, Fannin County Records, as modified by instrument recorded in Deed Book 1137, page 590, said records; said Deed to Secure Debt being given to secure a promissory note of even date, in the original principal amount of $129,000.00, with interest from date as stated therein, the holders, ROBERT K. CONDON and NORA LEE CONDON, will offer the property described below for sale at public outcry to the highest bidder for cash before the courthouse door at Fannin County, Georgia, within the legal hours of sale on the first Tuesday in February, 2017. The property is described as follows: All that tract or parcel of land lying and being located in Land Lot No. 157 & 158, 8th District, 2nd Section, Fannin County, Georgia, containing 1.16 acres of land, more or less, as shown on plat of survey prepared by Lane S. Bishop, GRLS# 1575, dated October 13, 1993, recorded in Plat Hanger A-519, Page 1, Fannin County, Georgia Records. Said plat is incorporated herein by reference thereto for a more complete description of the above-described property. Subject to a non-exclusive and perpetual easement over, across and through a strip of thirty feet (30') in width, as set forth in Deed Book 342, Pages 800-801, Fannin County, Georgia Records. Subject to all easements, restrictions, and rights of way as shown on above referenced plat or as otherwise appearing of record. Subject to existing easements and right of ways for public roads, if any. This conveyance made together with right of ingress, egress and utility service along existing roads to the subject property. Subject to Fannin County, Georgia Subdivision regulations, Mobile Home regulations and any zoning or other ordinances, if any. Property known as 2969 Douthit Road, Mineral Bluff, Georgia 30559. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale including attorney's fees. To the best information, knowledge and belief of the undersigned, the property is presently in the possession of Valerie Bell. The property will be sold as the property of said Valerie Bell, and will be sold subject to all restrictions, liens, encumbrances, easements and other matters of record, if any, to which the Deed to Secure Debt is junior and inferior in terms of priority, and subject to any and all unpaid taxes or assessments relating to the property.
