STATE OF GEORGIA LIBERTY COUNTY NOTICE OF SALE UNDER POWER By virtue of the power of sale contained in that certain Deed to Secure Debt from Southeastern Commercial Contractors, Inc. to The Heritage Bank dated August 6, 2002, recorded in Deed Book 1094, Page 41, Liberty County Records. Said Deed to Secure Debt having been given to secure a Note dated June 26, 2013, in the original principal sum of TWO MILLION THREE HUNDRED FIFTY NINE THOUSAND FOUR HUNDRED NINETY FOUR and 59/100'ths DOLLARS ($2,359,494.59), with interest from said dates at the rate stated in said Notes on the unpaid balance until paid, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Liberty County, Georgia, within the legal hours of sale on the first Tuesday in February, 2017, the property described on Exhibit "A" attached hereto and incorporated herein by reference. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees. If there are more than one tracts under said deed, each tract will be sold individually. The individual or entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Sherrie Struble, 300 S. Davis, Georgia Registered Land Surveyor No. 1436, dated May 2, 2006, and being recorded in Plat Section O-7, Page 1A, in the Office of the Clerk of Superior Court of Liberty County, Georgia, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said lot of land being bounded, now or formerly, as follows: Northerly by Tract A, containing 0.929 of an acre, more or less; Easterly by Tract B, containing 0.991 of an acre, more or less; Southerly by lands of Willowbrook Subdivision; and Westerly by Tract A, all as shown on the above referred to plat of survey. Exhibit A: All of that certain tract or parcel of land situate, lying and being in the 1458th G.M. District of Liberty County, Georgia, containing 5.63 acres, as shown and represented on that certain plat of survey made and prepared by Joe P. Kinard, Jr., Georgia Registered Land Surveyor No. 1572, dated March 10, 1992 and recorded in Deed Book 580, Page 275, in the Office of the Clerk of Superior Court, Liberty County, Georgia, specific reference to which plat is made a part of this description and which plat is incorporated herein by reference for descriptive and all other purposes. Said parcel of land being bounded, now or formerly, as follows: Northerly by a drainage ditch and a private road providing access from South Main Street to the K-Mart Shopping Center; Westerly by the Kroger (formerly Food Max) Shopping Center (Tract "E" on the above described plat); Southerly by the public road providing access from South Main Street to Kroger (formerly Food Max) Shopping Center; and Westerly by the right of way of South Main Street, with a frontage thereon for this property 254.54 feet, more or less, all as more fully shown on the above described plat.
