gpn14 HS Foreclosures STATE OF GEORGIA COUNTY OF LIBERTY NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSEOn the 14th day of November 2013, JERRY L. DAVIS, ("Davis") executed a Promissory Note ("Note") and Deed to Secure Debt ("Deed") for $123,040.80 payable to Green Tree Servicing LLC, conveying property described in Exhibit "A", and recorded in the Office of the Clerk of Superior Court of Liberty County, Georgia, in Deed Book 01805, pages 00560-00561, both of which were subsequently assigned to The Bank of New York Mellon, f/k/a The Bank of New York, as trustee for Mid-State Capital Trust 2010-1, by Ditech Financial LLC, as servicer with delegated authority, ("Bank of New York") by assignment dated November 15, 2016, and recorded in aforesaid Clerk's Office. EXHIBIT "A" All that certain lot, tract or parcel of land situate, lying and being in the 15th G.M. District of Liberty County, Georgia, containing 1.15 acres, more or less, together with a fifty (50') foot access casement to Shell Road, as shown on a Plat of Survey for Ernestine Fleming, dated January 21, 1982, as prepared by Earl Floyd, G.R.L.S. #1349 and being recorded in Deed Book 266, page 208, Liberty County, Georgia Records. Said Plat being incorporated herein by reference and made a part hereof for a more complete description. Said property is subject to a fifty (50') access easement across the western boundary. Default has been made in the payment of installments due for December 2015, and all months subsequent thereto. Bank of New York declared the entire unpaid indebtedness due and payable in accordance with the terms of said Note, and the same has not been paid. The Deed provides that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Liberty County, Georgia, upon Bank of New York first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the Sheriff's advertisements are published, and where said property is located. NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Liberty County, Georgia, at public outcry on the first Tuesday in February 2017, between the legal hours of sale. Bank of New York will convey title to the purchaser as attorney-in-fact for Davis. The money derived from the sale will be applied: first to the expenses of said sale; secondly, to the amount due on said Note; and the balance, if any, shall be paid to Davis. TERMS: Cash, subject to State and County ad valorem taxes or assessment and any federal tax liens of record. Purchaser is to pay for all legal papers and revenue stamps.
