NOTICE OF FORECLOSURE OF RIGHT TO REDEEM [ REF. O.C.G.A., Section 48-4-5 et seq.; 48-4-45 & 48-4-46]
TO: MAYOLO M. CERVANTES and his Unknown Heirs at Law AND ALL PERSONS KNOWN AND UNKNOWN HAVING ANY RIGHT, TITLE INTEREST IN, OR LIEN UPON: 715 LINKS VIEW DRIVE LOT #10A, BEING A BUILDING LOT WITHOUT IMPROVEMENTS THEREON, SUGAR HILL, GEORGIA 30518; and as described in Deed Book 33208, Page 57; and further described as Map & Parcel R7348 055.
Take notice that: The right to redeem the following described property, to wit shall expire and be forever foreclosed and barred as of five oclock P.M. (5 P.M.) on and after Friday, January 27, 2017.
WHEREAS said levy was made for the purpose of collecting delinquent state and county ad valorem property taxes for the year 2015, 2014, 2013, 2012; and,
WHEREAS said levy was made on October 15, 2015 on the following described tract of land, to wit:
All that tract or parcel of land lying and being in Land Lot 348, of the 7th District, of Gwinnett County, Georgia, being Lot 10, Block A, of the Links at Sugar Hill (a/k/a The Links at the Sugar Hill Golf Course), Unit Two, as more fully shown on a plat recorded in Plat Book 58, Page 193, Gwinnett County, Georgia Records, being 715 Links View Drive, Sugar Hill, Georgia. 30518.
SUBJECT TO:
1. Encroachments, overlaps, boundary line disputes, easements, or other matters which would be disclosed by an accurate survey or inspection of the premises.
2. Right-of-way easement in favor of Sawnee Electric Membership Corporation, dated 6/26/64, recorded in Deed Book 216, Page 1, aforesaid records.
3. Right-of-way easement in favor of Sawnee Electric Membership Corporation, recorded in Deed Book 4734, Page 290, aforesaid records.
4. Easement in favor of the City of Sugar Hill, recorded in Deed Book 6405, Page 90, aforesaid records.
5. Easement in favor of the City of Sugar Hill, recorded in Deed Book 6405, Page 93, aforesaid records.
6. All matters and items as shown on recorded plat of survey in Plat Book 58, Page 193, aforesaid records.
7. Declaration of Covenants, restrictions and easements for The Links at Sugar Hill, dated April 6, 1995, recorded June 8, 1995, in Deed Book 11370, Pages 268-299, aforesaid records and as modified from time to time. All covenants, restrictions and warranties in favor of Showcase Custom Homes Inc., its successors and assigns, are covenants running with the land for a term of 20 years unless provided otherwise. Said covenants, shall control without exception and shall survive all subsequent closings; and shall inure to the benefit of Showcase Custom Homes Inc., and shall bind and obligate Grantee, each heir, successor, assign or party-in-interest, accordingly.
The Tax Deed to which this notice relates is dated December 1, 2015, and recorded in the Office of the Clerk of the Superior Court of Gwinnett County, Georgia in Deed Book 54020, Page 704 & 705.
