STATE OF GEORGIACOUNTY OF COLQUITT NOTICE OF SALEUNDER POWER Because of a default under the terms of the Security Deed executed by Betty Harrison Suber to CitiFinancial Services, Inc. dated February 5, 2009, and recorded in Deed Book 1032, Page 169, Colquitt County Records, said Security Deed having been last sold, assigned, transferred and conveyed to CitiFinancial Servicing, LLC, securing a Note in the original principal amount of $28,440.84, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, February 7, 2017, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: ALL THAT TRACT OR PARCEL OF LAND, SITUATED, LYING AND BEING IN THE COUNTY OF COLQUITT STATE OF GEORGIA, AND DESCRIBED AS FOLLOWS: 1.09 ACRES, MORE OR LESS, OF LAND LOT NUMBER 330 IN THE 8TH LAND DISTRICT OF COLQUITT COUNTY, GEORGIA, DESCRIBED AS BEGINNING AT A POINT ON THE ORIGINAL NORTH LINE OF SAID LOT 1406.27 FEET EAST OF THE ORIGINAL NORTHWEST CORNER OF SAID LOT, THENCE RUN SOUTH 30 MINUTES EAST 33.7 FEET TO THE CENTER OF A PUBLIC ROAD, THENCE RUN SOUTH 88 DEGREES 15 MINUTES EAST ALONG THE CENTER OF SAID ROAD 185.5 FEET TO A STAKE, THENCE RUN SOUTH 30 MINUTES EAST 255.2 FEET TO A STAKE, THENCE RUN NORTH 88 DEGREES 15 MINUTES WEST 185.5 FEET TO A STAKE, THENCE RUN NORTH 30 MINUTES WEST 255.20 FEET TO THE CENTER OF SAID COUNTY PUBLIC ROAD AND THE POINT OR PLACE OR BEGINNING AS SHOWN BY A PLAT OF SAID LANDS MADE BY HURLEY J. GRIFFIN ON JANUARY 7, 1974.TAX ID: C22-56.BEING THE SAME FEE SIMPLE PROPERTY CONVEYED BY WARRANTY DEED FROM GARY L. SUBER TO BETTY HARRISON SUBER . DATED 05/15/1991 RECORDED ON 10/1611991 IN BOOK 455, PAGE 122 IN COLQUITT COUNTY RECORDS, STATE OF GA. Said property is known as 871 Wilburn Murphy Road, Hartsfield, GA 31756, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
