Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by EDWARD E. BOYSEL AND MERLE L. BOYSEL to SOUTHTRUST BANK, NATIONAL ASSOCIATION , dated 06/10/1997, and Recorded on 06/10/1997 as Book No. 382 and Page No. 11, BEN HILL County, Georgia records, as last assigned to WELLS FARGO BANK, N.A. (the Secured Creditor), by assignment, conveying the afterdescribed property to secure a Note of even date in the original principal amount of $50,037.25, with interest at the rate specified
therein, there will be sold by the undersigned at public outcry to the highest bidder for cash at the BEN HILL County Courthouse within the legal hours of sale on the first Tuesday in February, 2017, the following described property: ALL OF LOT NUMBER ONE (1) IN LYNNWOOD HEIGHTS SUBDIVISION, BLOCK A IN LAND LOT NUMBER 150 IN THE THIRD LAND DISTRICT OF BEN HILL COUNTY, GEORGIA, AND BEING SHOWN ON THE PLAT OF SAID SUBDIVISION DATED FEBRUARY 16, 1966, AND REVISED NOVEMBER 11, 1967, AND FURTHER REVISED SEPTEMBER 25, 1968, AND RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF BEN HILL COUNTY, GEORGIA, IN PLAT BOOK 5, PAGE 109, AND PARTICULARLY DESCRIBED AS BEGINNING AT THE SOUTHWEST CORNER OF THE IN-
TERSECTION OF THAT CERTAIN PUBLIC ROAD KNOWN AS CEDAR LANE WITH THAT CERTAIN PUBLIC STAKE, THENCE SOUTH 00 DEGREES 35 MINUTES 50 SECONDS WEST ALONG THE WEST MARGIN OF CEDAR LANE 121 FEET TO LOT NUMBER 2 AND WHICH POINT IS MARKED BY IRON STAKE ; THENCE NORTH 89 DEGREES 12 MINUTES 40 SECONDS WEST 150 FEET ALONG THE NORTH MARGIN OF SAID LOT NUMBER 2 TO AN ALLEY AND WHICH POINT IS MARKED BY AN IRON STAKE; THENCE NORTH 0 DEGREES
04 MINUTES 43 SECONDS EAST ALONG THE EAST MARGIN OF SAID ALLEY 121.6 FEET TO THE OLD AIRPORT ROAD AND WHICH POINT IS MARKED BY AND IRON STAKE;
THENCE SOUTH 89 DEGREES 06 MINUTES 18 SECONDS EAST ALONG THE SOUTH MARGIN OF SAID OLD AIRPORT ROAD 140.50 FEET TO THE POINT OF BEGINNING; AND BEING
THE SAME PROPERTY CONVEYED BY ROBERT L. SMITH AND MARGARET B SMITH TO MELVIN F. WILLIAMS, JR. AND ANGELA M. WILLIAMS BY WARRANTY DEED DATED
JUNE 5, 1995 AND RECORDED IN DED BOOK 337, PAGES 271272, IN SAID CLERK'S OFFICE AND BEING THE SAME PROPERTY SHOWN BY PLAT PREPARED BY M. RHETT
ROYAL, GEORGIA REGISTERED LAND SURVEYOR, DATED MAY 31, 1995.
The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). WELLS FARGO BANK, N.A. holds the duly endorsed Note and is the current assignee of the Security Deed to the property. WELLS FARGO BANK, N.A., acting on behalf of and, as necessary, in consultation with WELLS FARGO BANK, N.A. (the current investor on the loan), is the entity with the full authority to negotiate, amend, and modify all terms of the loan. To the best knowledge and belief of the undersigned, the party/parties in possession of the subject property known as 122 CEDAR LANE, FITZGERALD, GEORGIA 31750 is/are: EDWARD E. BOYSEL AND MERLE L. BOYSEL or tenant/tenants. Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances,
zoning ordinances, easements, restrictions, covenants, etc. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the security deed. Pursuant to O.C.G.A. Section 913172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as
