NOTICE OF PUBLIC SALE
Georgia, Ben Hill County
THIS IS AN ATTEMPT TO COLLECT A DEBT, AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
Under and by virtue of the power of sale contained in that certain security deed executed by Maxwell Anthony Reese, to Community Banking Company of Fitzgerald dated April 24, 2014, and recorded May 6, 2014, in Deed Book 846, pages 28-32, Deed Records of Ben Hill County, Georgia, and for the purpose of paying the indebtedness secured thereby, which is now due and payable, together with the costs of sale, the undersigned will sell on the first Tuesday in February, 2017 at public outcry to the highest bidder for cash before the courthouse door in Ben Hill County, Georgia, within the legal hours of sale, the following described property, to wit:
TRACT ONE
All of Lot No. 9 in Lakeview Acres Subdivision, being a portion of Land Lot No. 118, in the Third Land District of Ben Hill County, Georgia, as shown by the plat of said subdivision dated October 8, 1955, by B.L. Coburn, City Engineer, and recorded November 28, 1955 in Plat Book 2, Page 304 (Now Plat Slide No. 442), in the Office of the Clerk of the Superior Court of Ben Hill County, Georgia, and particularly described in accordance with said plat as beginning at a point on the south margin of that certain public road known as the Irwinville Highway at a point where the same is
intersected by the west margin of a certain public road known as Subeldon Lane; thence along the south margin of said highway in a general southwesterly direction 153 feet to an iron pipe and the property of C.O. Durden; thence south 01 degree east along said Durden property 185 feet; thence east 145 feet to Subeldon Lane; thence north along the west margin of said Subeldon Lane 233 feet to the south margin of said Irwinville Highway, the point and place of beginning.
Said lands are the same lands conveyed to Al Grimes and Betty L. Grimes by deed dated August 24, 1988, recorded on the Ben Hill County Deed Records in Deed Book 230, Pages 126-127.
TRACT TWO
A tract or parcel of land lying and begin in Land Lot No. 118, in the
Third Land District of Ben Hill County, Georgia, and particularly described as beginning at the northwest corner of Lot Number Eight in Lakeview Acres Subdivision, the same being the southwest corner of Lot Number Nine in
Lakeview Acres Subdivision, as shown by the plat of said subdivision recorded in Plat Book 2, Page 304 (Now Plat Slide No. 442), in the Office of the Clerk of the Superior Court of Ben Hill County, Georgia, thence from said point south 88 degrees 04 minutes west 23.4 feet to a point; thence north 01 degree 14 minutes west 180.20 feet to an iron stake located upon the southeast right of way line of Georgia State Route Number 107; thence
north 68 degrees 16 minutes east along the southeast right of way line of said State Route Number 107 25.0 feet to an iron stake situated upon said southeast right of way line; thence south 01 degree 14 minutes east 188.50 feet along the west margin of said Lot Number Nine to the southwest corner of said Lot Number Nine, the same being the point and place of beginning. Said lands are the same lands conveyed to Al Grimes and Betty L. Grimes by deed dated August 30, 1989, recorded on the Ben Hill County Deed Records in
Deed Book 243, pages 183-184.
The physical address of said property is 316 Irwinville Highway, Fitzgerald, GA 31750.
The said property will be sold subject to (a) any and all taxes and assessments levied or assessed prior to the current year, (b) ad valorem
taxes for the current year, (c) all liens, encumbrances, and other matters of record, if any, that are superior to or have priority over the security deed being foreclosed, and (d) final confirmation that at the time of the sale being advertised herein there was no automatic stay in effect with respect to the above described property due to the filing of a petition for relief under any chapter of the United States Bankruptcy Code with respect to a person having an interest in the above described property.
Notice is hereby given that under the provisions of O.C.G.A. § 9-13-172.1, the Secured Creditor may under certain circumstances rescind the sale being advertised herein, within 30 days after the sale but before the foreclosure deed or deed under power has been delivered to the purchaser at such sale.
Unless the sale is rescinded as hereinabove provided, a conveyance will be executed to the purchaser at such sale as authorized under the power of sale contained in the Security Deed aforesaid.

Matt McCranie, is the creditor's employee at such location who has the authority to negotiate, amend, and modify all of the terms of the foregoing security deed and the indebtedness secured thereby, although he is not obligated to negotiate, amend, or modify the said security deed or the indebtedness secured thereby.
