NOTICE OF SALE UNDER POWER, Ben Hill County State of Georgia Pursuant to the Power of Sale contained in a Security Deed given by Robert B. Brown to Mortgage Electronic Registration Systems, Inc., as nominee for Suntrust Mortgage, Inc. dated 4/25/2008 and recorded in Deed Book 699 Page 215 Ben Hill County, Georgia records; as last transferred to or acquired by Federal National Mortgage Association (“Fannie Mae”), a corporation organized and existing under the laws of the United States of America, conveying the after-described property to secure a Note in the original principal amount of $180,000.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Ben Hill County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on February 07, 2017 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: 0.53 acre, more or less, and being all of City Lots 3, 4 and 5 and an unnumbered 15-foot strip lying between said Lots 4 and 5, in Square 12 in Block 14 in the City of Fitzgerald, formerly Irwin, now Ben Hill County, Georgia, as shown by the plat of said city made by or for the American Tribune Soldiers Colony Company of file in the office of the Clerk of the Superior Court of Irwin County, Georgia, and being more particularly described as follows: To locate the point of beginning start at the point of intersection of the east margin of the right of way of Lee Street with the north margin of the right of way of Lemon Street and run thence along the east margin of the right of way of Lee Street north 01 degree 10 minutes 20 seconds west 80.00 feet to the point that shall be referred to as the point of beginning; running thence from said point of beginning along the east margin of the right of way of Lee Street north 01 degree 10 minutes 20 seconds west 135.00 feet; thence north 88 degrees 49 minutes 40 seconds east 170 feet 10 inches; thence along the west margin of the right of way of a 20-foot alley south 01degree10 minutes 20 seconds east 135.00 feet; thence south 88 degrees 49 minutes 40 seconds west 170 feet 10 inches to the point of beginning; all as shown on that certain plat of survey prepared for Robert B. Brown by James D. Weeks, Georgia Registered Land Surveyor No. 2111, dated September 19, 2006, recorded in Plat Slide No. 678-C2, in the office of the Clerk of the Superior Court of Ben Hill County, Georgia. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property is commonly known as 710 S Lee Street, Fitzgerald, GA 31750 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Robert B. Brown or tenant or tenants. Seterus, Inc. is the entity or individual designated who shall have full authority to negotiate, amend and modify all terms of the mortgage. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
