IN THE SUPERIOR COURT OF RICHMOND COUNTY STATE OF GEORGIA FRANCES WARREN RHODES, JOHN SCOTT COLEMAN, III, DAVID E. LEIGH, and FRIENDS OF THE COLEMAN-LEIGH- WARREN CEMETERY, PLAINTIFFS, VS. JOHN DOE and ALL OF THE HEIRS AND OWNERS OF A FRACTIONAL INTEREST IN THE WARREN CEMETERY PROPERTY LOCATED SOUTH OF OAKDALE ROAD IN AUGUSTA-RICHMOND COUNTY, IN THE NATIONAL HILLS AREA, HEIRS AND DESCENDANTS OF OTHER PERSONS BURIED ON THE WARREN CEMETERY PROPERTY, and AUGUSTA-RICHMOND COUNTY, GEORGIA, DEFENDANTS NOTICE OF SUMMONS BY PUBLICATION TO: JOHN DOE and ALL OF THE HEIRS AND OWNERS OF A FRACTIONAL INTEREST IN THE WARREN CEMETERY PROPERTY LOCATED SOUTH OF OAKDALE ROAD IN AUGUSTA-RICHMOND COUNTY IN THE NATIONAL HILLS AREA, HEIRS AND DESCENDANTS OF OTHER PERSONS BURIED ON THE WARREN CEMETERY PROPERTY The above-caption action is a proceeding in rem to establish title to property and to determine the rights of those whose relatives are buried in said cemetery; to declare that a certain cemetery has not been abandoned; and to recover certain monies from Augusta-Richmond County, Georgia which has received funds from the lease of a cell tower located on said property consisting of a 1.1 acre tract of land which is more particularly described in a deed recorded in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Deed Book 3X, page 202, which deed and survey was prepared by E.W. Brown in 1887. The above-captioned action was filed in the Superior Court of Richmond County, Georgia, on DECEMBER 14, 2016 and an Order for Service by Publication was entered by DECEMBER 19, 2016. This Court has also appointed STEVE HAGLER as Special Master. This Notice is directed and addressed to all unknown heirs of the late Benjamin H. Warren (who departed this life in 1870) and those who have relatives buried in the cemetery and who would claim an interest in said cemetery. This Notice hereby commands said heirs and relatives to file with the Clerk of the Superior Court of Richmond County, Georgia and to serve upon the Plaintiff's attorney an answer within sixty (60) days of the date of the Order for Service by Publication.
