NOTICE OF FORECLOSURE SALE UNDER POWER RICHMOND COUNTY, GEORGIA THIS IS AN ATTEMPT TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. Under and by virtue of the Power of Sale contained in a Security Deed given by Melba B. Page to Mortgage Electronic Registration Systems, Inc., as nominee for SunTrust Mortgage, Inc., dated March 14, 2012, and recorded in Deed Book 01340, Page 1928, Richmond County, Georgia Records, as last transferred to SunTrust Mortgage Inc by assignment recorded on September 14, 2016 in Book 01548 Page 0586 in the Office of the Clerk of Superior Court of Richmond County, Georgia Records, conveying the after-described property to secure a Note in the original principal amount of Seventy-Nine Thousand Six Hundred Sixty-Four and 0/100 dollars ($79,664.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash before the courthouse door of Richmond County, Georgia, within the legal hours of sale on January 3, 2017, the following described property: ALL that lot or parcel of land with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being shown and designated as Lot 1, Block K, St. Georges Townhouses, Phase One, Section One, as shown on a plat prepared by Southern Partners, Inc. dated August 30, 1999 and September 29, 1999, which is filed for record in the Office of the Clerk of the Superior Court of Richmond County, Georgia, in Realty Reel 666, Pages 1026-1027; reference being made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. Said property is conveyed subject to and with notice of the following matters: a) drainage easements, building setback lines, and all other matters shown on the plat of record; b) general utility easements and road right-of-way grants and easements. Said property is hereby conveyed subject to a Declaration of Rights, Restrictions, Affirmative Obligations and Conditions Applicable to St. Georges which is recorded in the aforesaid Clerk's Office in Realty Reel 666 Pages 1022-1033 and a Declaration of Covenants and Restrictions Providing for St. Georges Association, Inc. recorded on Realty Reel 666 Pages 1034-1042. and to any and all easements and restrictions of record in the aforesaid Clerk's office. Tax map & parcel number: 030-3-096-00-0 Said property being commonly known as 4007 Calypso Drive, Augusta, Georgia 30909. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is The Estate of Melba B. Page or tenant(s); and said property is more commonly known as 4007 Calypso Drive, Augusta, GA 30909. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code (2) final confirmation and audit of the status of the loan with the holder of the security deed and (3) any right of redemption or other lien not extinguished by foreclosure.
