gpn14 HS Foreclosures STATE OF GEORGIA COUNTY OF LIBERTY NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT THIS LAW FIRM IS ACTING AS A DEBT COLLECTOR ATTEMPTING TO COLLECT A DEBT. ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE. On June 24, 2010,ANDRE C. HOLMES ("Holmes"), executed a Note ("Note") in the original principal sum of $264,985.00, secured by a Security Deed ("Deed") dated June 24, 2010, payable to Mortgage Electronic Registration Systems, Inc., conveying property described in Exhibit "A" attached, and recorded in the Office of the Clerk of Superior Court of Liberty County, Georgia, in Book 01638, pages 00185-00195. Said Note an Deed were subsequently assigned to Georgia Bank & Trust Company of Augusta ("Georgia Bank") by Transfer and Assignment dated February13, 2012, and recorded in aforesaid Clerk's Office in Deed Book 01711, page 00081. EXHIBIT "A" All that certain lot, tract or parcel of land situate, lying and being in the 1359th G. M. District of Liberty County, Georgia, and being in the City of Midway, being known and designated as Lot No. 23, Hickory Hill Subdivision, Phase II, as shown and represented on that certain plat of survey made and prepared by Joe P. Davis, Georgia Registered Land Surveyor No. 1436, bearing a survey date of February 20, 2009, and a plat date of February 21, 2009, and being recorded in Plat Section P-003 page 413, in the Office of the Clerk of Superior Court of Liberty County, Georgia, said plat by specific reference is made a part hereof for descriptive and all other purposes. Said lot of land being bounded, now or formerly, as follows: Northerly by lands of Liberty Manor Nursing Home; Easterly by Lot No. 24; Southerly by the right of way of Kettle Creek Lane; and Westerly by Lot No. 22, all as shown on the above referred to plat of survey. Default has been made in the payment of installments on the Note. Georgia Bank declared the entire unpaid indebtedness due and payable in accordance with the terms of the Note and the same has not been paid. The Deed provides that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Liberty County, Georgia, upon Georgia Bank first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the Sheriff's advertisements are published, and where said property is located. NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Liberty County, Georgia, at public outcry on the first Tuesday in December 2016 between the legal hours of sale. Georgia Bank will convey title to the purchaser as attorney-in-fact for Holmes. The money derived from the sale will be applied: first to the expenses of said sale; secondly, to the amount due on said Notes; and the balance, if any, shall be paid to Holmes. TERMS: Cash, subject to State and County ad valorem taxes or assessment and any federal tax liens of record. Purchaser is to pay for all legal papers and revenue stamps.
