gpn14 HS Foreclosures NOTICE OF SALE UNDER POWER GEORGIA, LONG COUNTY Under authority of the powers of sale and conveyance contained in that certain Deed to Secure Debt given by LARRY MOODY to LUDOWICI BANK, a Division of Glennville Bank, dated April 28, 2009, the same being recorded in Deed Book 323, Pages 279-285, Long County Records, conveying the after-described property to secure a Note dated April 28, 2009, executed by LARRY M. MOODY, in the original principal amount of TEN THOUSAND FIVE HUNDRED THIRTY AND 30/100 DOLLARS ($10,530.30), with interest thereon as set forth therein, there will be sold on the first Tuesday in January, 2017, within the legal hours of sale, before the Courthouse door in Ludowici, Long County, Georgia, at public outcry to the highest bidder for cash, the land conveyed in said security deed described as follows: All that certain lot, tract or parcel of land situate, lying and being in the 1544th G.M. District of Long County, Georgia, containing one (1) acre, more or less, and being described generally as follows: Beginning at a point on the Southwest margin of the right of way of US Route No 99 (now designated as Highway No. 57) at a point approximately 10 miles southeast of Ludowici, Georgia, at a stake and from said stake run along the margin of State Highway No. 99 (now designated as Highway No. 57) in a Southeasterly direction South 42 East for a distance of 112 feet to a pipe; thence turn and run in a Southwesterly direction south 43 West for a distance of 493 feet to an iron pin; thence turn and run in a Northwesterly direction North 55 West for a distance of 118 feet to a concrete marker; thence turn and run in a Northeasterly direction North 43 East for a distance of 415 feet to the stake at the point of beginning. Said lot of land being bounded, generally, as follows: Northeast by the right of way of State Highway No. 99 (now designated as Highway 57); Southeast by lands of Mrs. Rufus Smith (Cora M. Smith); Southwest by lands of Lennie Mae M. Harrison; Northwest by lands of Delores M. Parker. Said property is more accurately depicted by metes, bounds, courses and distances on a plat of survey prepared by Herman Parker, Georgia Registered Land Surveyor No. 88, dated March 1, 1968, and recorded in the office of the Clerk of Superior Court of Long County, Georgia, in Plat Book 2, Page 282. Said plat is incorporated herein by reference for descriptive and all other purposes. Said property is the same as that received by Larry Moody by Warranty Deed from Terry L. Sanders, dated April 28, 2009, and recorded in the office of the Clerk of Superior Court of Long County, Georgia, in Deed Book 323, Page 277. The indebtedness secured by said Deed to Secure Debt has become in default as to principal and interest because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed and the whole amount of said indebtedness is declared to be in default and immediately due and payable, and the above-described property will be sold for the purpose of enforcing payment of the indebtedness secured by said Deed to Secure Debt. A deed will be executed to the purchaser at said sale conveying title as authorized in said Deed to Secure Debt. The proceeds of said sale will first be applied to the payment of the indebtedness to Ludowici Bank, other charges and the expenses of sale as provided in said Deed to Secure Debt including attorney's fees (notice of intent to collect attorney's fees having been given) and the excess, if any, as provided by law. Said sale and the deed made to the purchaser at said sale will be subject to any outstanding unpaid ad valorem taxes on said property (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. To the best knowledge and belief of the undersigned, the party in possession of the property is Larry M. Moody, or a tenant or tenants.
