Georgia, Jackson County
By virtue of the power of sale contained in the Security Deed by and between PAM MONTEVALVO, (“Grantorâ€) to LOUANN M. MASSEY (“Granteeâ€) dated September 5, 2012, and recorded in Deed Book 63M, Page 494, Jackson County Records conveying the realty described herein as collateral for the debt in the principal amount of $20,000.00 together with all late fees and interest from dates of execution at the rates provided therein on the unpaid balance; there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Jackson County Georgia or at such other place as sheriff's sales are conducted in said County, within the legal hours of sale on the first Tuesday of December, 2016, the realty being more completely described as follows:
All that tract or parcel of land lying and being in Jackson County, Georgia, 253rd G.M.D., and being shown and designated as Tract 3 containing 5.00 acres, more or less, in that certain “Survey for Louann M. Massey,†prepared by Max Lewallen, Registered Land Surveyor No. 2067, dated August 29, 1991, recorded in Plat Book 37, Page 94, Jackson County, Georgia Records, which plat is incorporated by reference herein.
LESS AND EXCEPT: All that tract or parcel of land, lying and being in Jackson County, Georgia, 253rd G.M.D., and being shown as 2.00 acres, more or less, in that certain “Boundary Survey for Louann M. Massey,†prepared by Venable & Associates, Inc., Allen L. Venable, Registered Land Surveyor No. 1761, dated March 3, 2004, together with and subject to a 20' ingress-egress easement as shown on said plat, recorded in Plat Book 63, Page 36, Jackson County, Georgia Records, which plat is incorporated by reference herein.
Said property bears the address J S WILLIAMS COURT, NICHOLSON, GEORGIA.
The debt secured by said Security Deed has been and is hereby declared due and payable because, among other possible events of default, of the borrower's failure to pay the interest and principal when due. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), and any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of Grantee, the party in possession of the property is Grantor or a tenant or tenants.
