Notice of Sale Under Power

Under and by virtue of the power of sale contained in deed to secure debt given by EMILIA PEREZ to LEON PRESLEY, dated January 23, 2013, filed January 25, 2013 and recorded in Deed Book 64P, at Page 779, Jackson County, Georgia Records, within the legal hours of sale on the first Tuesday in December, the following described property:
All that tract or parcel of land, together with all improvements thereon, lying and being in the 428, G.M., District, Jackson County, consisting .96 acres, more or less, and designated as “Tract 2†on that plat of survey, prepared for Gene Funderburk by W.T. Dunahoo and Associates, Inc. dated September 9, 1980, as recorded in Plat Book 18, Page 32, Jackson County, Georgia Records. Said plat by reference thereto is hereby incorporated herein for a more detailed description of same and said property is further described by said plat as follows:
BEGINNING at and iron pin set of the Northerly right of way of Old State Road 233.7 feet Westerly of Dry Pond Road; thence North 32° 27' East 242.8 feet to an iron pin found; thence North 67° 32' East 180.2 feet along an old road bed to and iron pin found; thence following said old road bed road bet North 51° 45' West 125.3 feet to an iron pin found; South 12° 16' East 188.8 feet to an iron pin set; thence South 14° 43' East 116.8 feet to an iron pin set on the Northerly right of way of Old State Road; thence along said right of way South 50° 17' East 84.3 feet to the point of BEGINNING.
Said property is conveyed with all easements, rights of way, and covenants of record.

Said deed to secure debt having been given to secure a note of even date in the original principal amount of $49,000.00 with interest from date at the rate as specified therein.
The debt secured by said deed to secure debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the note and deed to secure debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the deed to secure debt and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the security deed first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, covenants, etc.
