Notice of Sale Notice of Sale Under Power State of Georgia County of Jackson By virtue of the power of sale contained in that certain security deed given by Stephen R. Jones and Cathy Y. Jones to First Georgia Banking Company dated as August 6, 2007 and recorded on August 24, 2007, filed for record in Book 49W, Page 65, Jackson County, Georgia Records; as assigned by the Federal Deposit Insurance Corporation, as receiver for First Georgia Banking Company, to CertusBank, N.A. pursuant to an assignment filed for record in Book 65H, Page 33, Jackson County, Georgia Records and also pursuant to an assignment filed for record in Book 74Y, Page 700, Jackson County, Georgia Records; as assigned by CertusBank, N.A. to RREF II CER CO Acquisitions, LLC pursuant to an assignment filed for record in Book 74Y, Page 697, Jackson County, Georgia Records; as assigned by RREF II CER CO Acquisitions, LLC to RREF II CER CO-GA, LLC pursuant to an assignment filed for record in Book 75D, Page 753, Jackson County, Georgia Records (collectively, the “Security Deed”), said Security Deed having been given to secure a Home Equity Line of Credit in the original principal sum of Fifty Thousand and No/100 Dollars ($50,000.00) (the “Line of Credit”), with interest at the rate stated in said Line of Credit on the unpaid balance until paid, which has merged into a judgment entered on September 18, 2013 in the Superior Court of Jackson County, Georgia, in Civil Action 13V0608 for the amount of $52,202.83, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Jackson County, Georgia, between the hours of 10:00 a.m. and 4:00 p.m. on January 3, 2017, the following described property: All that tract or parcel of land, together with all improvements thereon, situate, lying and being in the 253rd GMD, Jackson County, Georgia, being known and designated as Tract #1, containing 20.733 acres, more or less, and being more particularly described according to a plat of survey entitled “Survey for Steve and Yvette Jones” dated June 10, 2003, by Tim Wilkes, RLS, recorded in Plat Book 60, page 277, Jackson County records and incorporated herein; being the same property conveyed by deed recorded in Deed Book 30-S, page 192, said records. The debt secured by the herein described Security Deed has been declared due because of, among other possible events of default, failure to pay the indebtedness when due and in the manner provided in the Line of Credit and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys' fees.
