Under and by virtue of the power of sale contained in a Security Deed and Agreement from CHARLES ANDREW MOON a/k/a ANDREW MOON, JR. to Capital Mortgage Corporation (as to a 60% undivided interest), First Financial Funding, Inc. (as to a 30% undivided interest) and Prime Equity Lending, Inc. (as to a 10% undivided interest), dated March 3, 2008, recorded March 19, 2008 in Deed Book 48716, Page 63, Gwinnett County, Georgia records; also recorded March 4, 2008, in Deed Book 4496, Page 154, Rockdale County, Georgia records and recorded April 3, 2008 in Deed Book 20732, Page 443, DeKalb County, Georgia records; said Security Deed modified by Modification Agreement (Modification) dated June 24, 2009, recorded March 31, 2010 in Deed Book 50003, Page 645, Gwinnett County, Georgia records; said Modification also recorded February 10, 2010 in Deed Book 4819, Page 224, Rockdale County, Georgia records and recorded March 12, 2010 in Deed Book 21888, Page 559, DeKalb County, Georgia records; said Security Deed as last transferred to CRIMSON PORTFOLIO, LLC by Transfer and Assignment recorded in Deed Book 54296, Page 642, Gwinnett County, Georgia records; said Assignment also recorded in Deed Book 25586, Page 530, DeKalb County, Georgia records and recorded in Deed Book 5870, Page 214, Rockdale County, Georgia records; said Security Deed being given to secure an indebtedness owed by CHARLES ANDREW MOON a/k/a ANDREW MOON, JR., together with interest due thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Rockdale County, Georgia, within the legal hours of sale on the first Tuesday in January, 2017, the following described property:
All that tract or parcel of land situate, lying and being in Land Lot 344 and 345 of the Fourth Land District of Gwinnett County, Georgia, Land Lot 283 and 256 of the 16th District of DeKalb County, Georgia and Land Lot 283 of the 16th Land District of Rockdale County, Georgia being identified as Tract 1, containing 65.465 acres, Tract 2, containing 3.781 acres, Tract 3, containing 0.722 acres, Tract 4, containing 0.330 acres and Tract 5, containing 0.330 acres according to plat of survey for Charles Andrew Moon, Jr., dated May 2, 2006 made by Gary L. Cooper, Adam & Lee Land Surveying of record in Plat Book 117, Page 161, in the Office of the Clerk of the Superior Court of Gwinnett County, Georgia of record in Plat Book 181, Page 14, in the Office of the Clerk of the Superior Court of DeKalb County, Georgia, of record in Plat Book ___, Page ___, in the Office of the Clerk of the Superior Court of Rockdale County, Georgia and being more particularly shown on Exhibit B attached to the Security Deed recorded in Deed Book 4496, Page 154, Rockdale County, Georgia records and made a part hereof, reference to which plat is hereby made for a more particular and accurate description of the property herein conveyed.
LESS AND EXCEPT: All that tract or parcel of land lying and being in Land Lot 282 of the 16th District of DeKalb County and the 4th District of Rockdale County, Georgia being Tract 4 containing 0.330 acres as per plat of survey for Charles Andrew Moon, Jr., by Adam & Lee Land surveying dated May 2, 2006 and being more particularly described as follows:
Beginning at the land lot corner that is common to Land Lots 282, 257, 256 and 283 of the 16th District of DeKalb County, proceed North 00 degrees 21 minutes 41 seconds East along the land lot line common to Land Lots 256 and 283 for a distance of 782.45 feet to a 1/2 inch rebar found; thence leaving the land lot line proceed South 47 degrees 56 minutes 36 seconds East 240.73 feet to an iron pin found; thence South 05 degrees 06 minutes 48 seconds East 138.07 feet to an iron pin found; thence South 49 degrees 10 minutes 44 seconds East 380.50 feet to a point being the True Point of Beginning; thence South 83 degrees 23 minutes 28 seconds East 343.72 feet to an iron pin set on the county line common to DeKalb and Rockdale Counties; thence leaving said county line, proceed South 83 degrees 56 minutes 28 seconds East 85.32 feet to an iron pin set; thence South 83 degrees 56 minutes 07 seconds West 108.42 feet to an iron pin found on the county line common to DeKalb and Rockdale Counties; thence leaving said county line, proceed South 83 degrees 56 minutes 07 seconds West 75.22 feet to an iron pin found; thence South 89 degrees 30 minutes 42 seconds West 162.36 feet to a point; thence North 49 degrees 10 minutes 44 seconds West 107.33 feet to the True Point of Beginning.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
To the best knowledge and belief of the undersigned, the party in possession of the property is CHARLES ANDREW MOON a/k/a ANDREW MOON, JR. or a tenant or tenants.
