NOTICE OF SALE UNDER POWER
STATE OF GEORGIA
COUNTY OF GILMER
By virtue of the power of sale contained in a Security Deed dated
February 1, 2006, filed for record February 9, 2006, and recorded in
Deed Book 1232, Page 102-108, Gilmer County, Georgia Records, given
by WILLIAM J. MASSEY and PAMELA L. MASSEY to GEORGIA FARMS AND
LANDS, INC., and assigned to Realty Resources Corporation Profit
Sharing Plan, a Georgia Corporation at Deed Book 1430, Page 217-218
Gilmer County Records, there will be sold at public outcry for cash
to the highest bidder before the Court House Door of Gilmer County,
Georgia, between the legal hours of sale on the first Tuesday in
March, 2016 by Realty Resources Corporation Profit Sharing Plan the
following described property, to-wit:
ALL THAT TRACT OR PARCEL OF LAND, lying and being in the 12th District,
2nd Section of Gilmer County, Georgia, being Lot 44 of Whitestone
Subdivision- Phase Three, and being more particularly shown and
delineated on a certain Plat recorded at Plat Book 36, Page 176,
Gilmer County, Georgia Records.
Said Security Deed was given to secure payment of a Note being in the
original principal amount of Thirty Seven Thousand Three Hundred
Nineteen and No /100 Dollars ($37,319.00), until reaching maturity,
bearing interest on the unpaid balance as specified therein. The
unpaid principal balance has been and is hereby declared due because
of default under the terms of said Note and Deed to Secure Debt.
The debt remaining in default, said sale will be made for the
purpose of applying the proceeds thereof toward the expenses of
sale, including attorneys fees, the payment of the debt and the
interest thereon; and the balance, if any, shall be applied as
provided by law.
Said property will be sold subject and subordinate to the following items
which may affect the title to said property: all zoning ordinances;
matters which would be disclosed by an accurate survey or by an
inspection of the property; any outstanding taxes, including, but
not limited to, ad valorem taxes, which constitute liens upon said
property; special assessments; all outstanding bills for public
utilities which constitute liens upon said property; all restrictive
covenants, easements, rights-of-way and any other matters of record
superior to said Security Deed. To the best knowledge and belief of
the undersigned, WILLIAM J. MASSEY and PAMELA L. MASSEY are the
parties in possession of the property. Notice has been given
pursuant to and in compliance with O.C.G.A. 44-14-162, et. seq.
The above-described property will be sold by the undersigned as
attorney-in-fact for WILLIAM J. MASSEY and PAMELA L. MASSEY, subject
to any and all unpaid taxes and assessments, and matters of record.
