NOTICE OF SALEUNDER POWER State of GeorgiaCounty of Colquitt NOTICE OF SALEUNDER POWER CONTAINED INSECURITY DEED Under and by virtue of the power of sale contained in that certain Security Deed (the Security Deed) from Bettie Jean Zemberi (hereinafter referred to as "Grantor") to The Trust Bank, a State Banking Company operating under the laws of the State of Georgia (hereinafter referred to as "Grantee"), dated June 24, 2014 and recorded in Deed Book 1210, Page 474, in the Office of the Clerk of the Superior Court of Colquitt County, with said Security Deed being given to secure payment of that certain Promissory Note dated April 27, 2015 given by Dawn Hall in favor of The Trust Bank in the original principal amount of Fifty five thousand three hundred twenty four and 75/100 Dollars ($55,324.75), there will be sold by the undersigned at public outcry to the highest bidder for cash before the courthouse door at Colquitt, Georgia, within the legal hours of sale on the first Tuesday in January, 2017, namely January 3rd, 2017, the property conveyed by said Security Deed and described as follows, to-wit: All that tract or parcel of and situate, lying and being in Land Lot No. 123, 9th Land District of Colquitt, County, Georgia, being 15 acres, more or less, in the form of a triangle and bonded as follows: South by Lenox-Moultrie Paved Road; West part of way by lands of L.G. Lindsey, part of way by run of branch and part of way by lands of Patsy Willis and Ruth Tucker; and East by an unpaved road. All that tract or parcel of land situate, lying and being 1.00 acres, more or less, in Land Lot Number 123 in the 9th Land District of Colquitt County, Georgia, and being more particularly on that plat of survey entitled Plat of survey for Bettie Jean Zemberi, prepared by Jerry S. Lindsey Land Surveyor, Inc., dated 10-31-02 and recorded in Plat Book 37, Page 69, in the office of the Clerk of Colquitt County Superior Court; said plat and record thereof are incorporated herein and made a part of this description. This being a portion of the land conveyed in Warranty Deed recorded in Deed Book 588, Page 446, in the office of the Clerk of Colquitt County Superior Court. All that tract or parcel of land situate, lying and being 1.00 acres, more or less, in Land Lot Number 123 in the 9th Land District of Colquitt County, Georgia, and being more particularly described on that plat of survey entitled Plat of survey for Dawn S. Hall, prepared by Jerry S. Lindsey Surveyor, Inc., dated 10-31-02 and recorded in Plat Book 37, Page 70, in the office of the Clerk of Colquitt County Superior Court; said plat and record thereof are incorporated herein and made a part of this description. This being a portion of the land conveyed in Warranty Deed recorded in Deed Book 588, Page 446, in the office of the Clerk of Colquitt County Superior Court. All that tract or parcel of land situate, lying and being in Land Lot 123, 9th Land District, Colquitt County, Georgia, and being 2.00 acres, all according to a plat of survey prepared by Daniel L. Hinson, registered land surveyor, dated October 31, 2002, and recorded in Plat Book 37, Page 8, Colquitt County Deed Records, which plat is incorporated herein and made a part of this description. All that tract or parcel of land situate, lying and being 3.61 acres, in Land Lot Number 123, 9th Land District, Colquitt County, Georgia, and being more particularly described on that plat of survey thereof prepared by Jerry S. Lindsey Land Surveyor, Inc., recorded in Plat Book 36, Page 179, Colquitt County, Georgia, deed records; said plat and record thereof are incorporated herein and made a part of this description. This being a portion of the land conveyed in Warranty Deed recorded in Deed book 588, Page 446, in the office of the Clerk of Colquitt County Superior Court. All that tract or parcel of land situate, lying and being 1.00 acres, more or less, in Land Lot Number 123 in the 9th Land District of Colquitt County, Georgia, and being more particularly described on that plat of survey entitled Plat of survey for Bettie Jean Zemberi, prepared by Jerry S. Lindsey Land Surveyor, Inc., dated 10-31-2002 and recorded in Plat Book 37, Page 69, in the office of the Clerk of Colquitt County Superior Court; said plat and record thereof are incorporated herein and made a part of this description. The property will be sold together with easements, rights, improvements, fixtures, equipment, furniture, furnishings, appliances and appurtenances related thereto, including all buildings, structures, parking facilities and improvements of every nature whatsoever now or hereafter situated on the above described property, owned by Grantor and located in, on, or about or used or intended to be used with or in connection with the use, operation, or enjoyment of the above described property, if any. Because of the default in the payment of the installments due under the Note which the Security Deed was given to secure, the undersigned has declared the entire indebtedness due and payable, and said property will be sold as the property of Grantor to satisfy the indebtedness evidenced by the Note together with the cost of said sale, including attorney's fees, notice having been given pursuant to the Official Code of Georgia Annotated Section 13-1-11. To the best of the undersigned's knowledge and belief, the party in possession of said property is Grantor or tenants claiming by, through or under Grantor. Said property will be sold as-is where-is subject to all zoning ordinances, restrictions, covenants, liens, encumbrances, easements and other matters of record, if any, to which the Security Deed is junior and inferior in terms of priority, and subject to any and all unpaid taxes or assessments relating to the property.
