NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COLUMBIA Under and by virtue of the power of sale (the "Power of Sale") contained in those certain Deeds to Secure Debt given by Team Excavating Company to AgGeorgia Farm Credit, ACA dated November 7, 2005, recorded in Deed Book 5159, Page 71, Clerk's Office, Columbia Superior Court AND that Deed to Secure Debt given by Team Excavating Company to AgGeorgia Farm Credit, ACA dated November 17, 2005, recorded in Deed Book 5182, Page 47, Clerk's Office, Columbia Superior Court (the "Security Deed"), conveying the after-described property to secure that certain Promissory Note executed by Team Excavating Company in favor of AgGeorgia Farm Credit, ACA, as agent/nominee, originally dated November 7, 2005, as well as that certain Promissory Note executed by Team Excavating Co. in favor of AgGeorgia Farm Credit, ACA, as agent/nominee, dated November 17, 2005 (the "Notes"), with interest thereon as set forth therein, there will be a sale at public outcry to the highest bidder for cash before the courthouse door of Columbia County, Georgia, within the legal hours of sale on the first Tuesday of December 2016, the following described property (the "Property"): All that tract or parcel of land lying and being in the 129th GMD, Columbia County, Georgia, known and designated as Lots 13, 14, 15, 17, 41 and 47, as well as approximately 5.4 acres of Open Space as appears on plat of survey prepared for Team Excavating Co., by Jerry Patrick Ward, Surveyor, dated February 2, 2008, and recorded in Plat book F121, Page 1, Columbia County Records. The above-described property is a portion of the property secured by those Deeds to Secure from Team Excavating Co., in favor of AgGeorgia Farm Credit, ACA, dated November 7, 2005, recorded in Deed Book 5159, Page 71, Clerk's Office, Columbia Superior Court AND that Deed to Secure Debt given by Team Excavating Company to AgGeorgia Farm Credit, ACA dated November 17, 2005, recorded in Deed Book 5182, Page 47, Clerk's Office, Columbia Superior Court SUBJECT to existing easements for public roads and utilities now in use. The proceeds from this sale will be applied first to the outstanding balance on the First Note and then, if there is any excess, it will be applied to the balance of the Second Note referenced above. THE INTENT OF THE GRANTOR HEREIN IS TO TRANSFER TO GRANTEE ALL OF THE PROPERTY SECURED BY THOSE SECURITY DEEDS IN FAVOR OF AGGEORGIA FARM CREDIT FROM TEAM EXCAVATING CO., IN FAVOR OF AGGEORGIA FARM CREDIT, ACA, DATED NOVEMBER 7, 2005, RECORDED IN DEED BOOK 5159, PAGE 71, CLERK'S OFFICE, COLUMBIA SUPERIOR COURT AND THAT DEED TO SECURE DEBT GIVEN BY TEAM EXCAVATING COMPANY TO AGGEORGIA FARM CREDIT, ACA DATED NOVEMBER 17, 2005, RECORDED IN DEED BOOK 5182, PAGE 47, CLERK'S OFFICE, COLUMBIA SUPERIOR COURT WHICH HAVE NOT BEEN RELEASED BY AGGEORGIA. The debts secured by said Security Deed have been and are hereby declared due as a result of failure to observe the requirements of the terms of the Notes and Security Deed. The debts remaining in default, this sale will be made for the purpose of paying same and, additionally, all expenses of this sale, as provided in the Security deed and by law, including without limitation attorney fees (the statutory notice of intent to collect attorney fees having been served). Said Property will be sold subject to any outstanding ad valorem taxes (including taxes that are a lien, but not yet due and payable); matters that may be disclosed by an accurate survey and/or inspection of the property; assessments, liens, encumbrances, zoning ordinances, restrictions, covenants; and matters of record superior to the Security Deed. Additionally, this sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) final confirmation and audit of the status of the loans with the holder of the Security Deed.
