NOTICE OF SALE
UNDER POWER
Because of a default under the terms of the Security Deed executed by Speedy Gonzalez to Mortgage Electronic Registration Systems, Inc. as nominee for Everett Financial Inc., DBA Supreme Lending dated February 28, 2013, and recorded in Deed Book 52053, Page 522, and Deed Book 54243, Page 105, Gwinnett County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Wells Fargo Bank, N.A. securing a Note in the original principal amount of $130,591.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, December 6, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit:
All that tract or parcel of land lying and being in Land Lot 93 of the 7th District of Gwinnett County, Georgia, being designated as Tract 1 of the W.T. Coker Estate, containing 2.433 acres, on plat of survey for Jimmy A. Brown and Dale R. Brown prepared by Gordon Story & Assoc., dated November 20, 1986, and being more particularly described as follows:
Beginning at a point located on the westerly right of way of GA. Hwy. No. 124 (having a 80-foot right of way) 173.11 feet southerly, as measured along the westerly right of way of GA. Hwy No. 124, from the point of intersection of the westerly right of way of GA. Hwy. No. 124, if extended, with the centerline of Sunny Hill Road, running thence South 24 degrees 55 minutes 30 seconds West along the westerly right of way of GA. Hwy. No 124, 40.00 feet to a point; thence North 89 degrees 52 minutes 25 seconds West 122.13 feet to a point; thence South 63 degrees 31 minutes 58 seconds West 886.96 feet to a point; thence South 26 degrees 28 minutes 02 seconds East 189.96 feet to a point, thence South 63 degrees 31 minutes 58 seconds West 399 80 feet to a point; thence North 27 degrees 12 minutes 00 seconds West 210.25 feet to a point; thence North 63 degrees 31 minutes 58 seconds East 1289.55 feet to a point; thence North 83 degrees 08 minutes 08 seconds East 149.00 feet to the point located on the westerly right of way of GA. Hwy. No. 124 and the point of beginning.
Said property is known as 1750 Braselton Hwy, Lawrenceville, GA 30043, together with all fixtures and personal property attached to and constituting a part of said property, if any.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the secured creditor.
The property is or may be in the possession of Speedy Gonzalez, successor in interest or tenant(s).
