UNDER POWER
By virtue of the Power of Sale contained in the Security Deed from Betty Quates to Georgia Federal Credit Union (N/K/A Georgia United Credit Union), dated October 25, 2006, filed and recorded November 6, 2006 in Deed Book 47221, Page 46, Clerk of Superior Court, Gwinnett County, Georgia Records as modified by Forbearance Agreement, Modification of Note and Security Deed dated May 16, 2013, filed and recorded May 31, 2013 in Deed Book 52260, Page 555, aforesaid Records (the Security Deed) and being given to secure a Note in the original principal amount of ONE HUNDRED THIRTY FOUR THOUSAND SIX HUNDRED AND 00/100 DOLLARS ($134,600.00) (the Note), with interest thereon on the unpaid balance until paid; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Gwinnett County, Georgia, within the legal hours of sale on the first Tuesday in December, 2016, the following described property:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 109, 5TH DISTRICT GWINNETT COUNTY, GEORGIA, BEING LOT 31, BLOCK A, UNIT TWO OF CREEKSIDE CROSSING SUBDIVISION, AS PER PLAT RECORDED IN PLAT BOOK 32, PAGE 286, GWINNETT COUNTY GEORGIA RECORDS, WHICH RECORDED PLAT IS INCORPORATED HEREIN AND MADE A PART HEREOF BY REFERENCE
The above described property has Gwinnett County Tax Parcel identification number R 5109 206 and is more commonly known as 971 Lauren Kay Court, Lawrenceville, GA 30046.
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installment payments due on the Note. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property will be sold as the property of Betty Quates, and subject to all outstanding ad valorem taxes and/or assessments, solid waste bills, water bills, sewer bills and other utility bills and Fi Fas or liens related thereto now or hereafter due and payable (including taxes which are a lien, but not yet due and payable), all easements, covenants, rights of way and restrictions of record, if any, having priority over said Security Deed, all zoning ordinances and development codes or restrictions, any other matters of record superior to said Security Deed, and any matters which would be disclosed by a current and accurate survey and inspection of said property.
To the best of the knowledge and belief of the undersigned, the party in possession of the property is Betty Quates or parties in possession under said Betty Quates, and said property is more commonly known as 971 Lauren Kay Court, Lawrenceville, GA 30046. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
