GILMER COUNTY
NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT
BY VIRTUE OF THE POWER OF SALE contained in a Deed to Secure Debt dated
December 18, 2015, from Joseph Lee Marshall to Doris Marshall, and
recorded in Deed Book 1951, pages 182-183, Gilmer County Records;
said Deed to Secure Debt being given to secure a promissory note of
even date, in the original principal amount of $15,000.00, with
interest from date as stated therein, the holder, DORIS MARSHALL,
will offer the property described below for sale at public outcry to
the highest bidder for cash before the courthouse door at Gilmer
County, Georgia, within the legal hours of sale on the first Tuesday
in December, 2016. The property is described as follows:
All that tract or parcel of land lying and being in the 25th District,
2nd Section of Gilmer County, Georgia and being a part of Land Lot
209, 210, 223 and 224 and designated as Lot 586 of Miller Rock,
Inc., Unit VII, as shown on a survey of Burns L. Jeffries, RLS
#2036, dated July 1, 1984, and recorded in Plat Book 12, page 70,
Gilmer County deed records to which reference is hereby made for a
complete and accurate description; together with a 1997 14X48
Fleetwood mobile home bearing Manufacturers Serial No.
GAFLT39A07425VH11, which is affixed to and a part of said real
property.
The physical address of the property is 278 Banner Circle, Ellijay,
Georgia 30540.
The debt secured by said Deed to Secure Debt has been and is hereby
declared due because of, among other possible events of default,
non-payment of the monthly installments on said loan. The debt
remaining in default, this sale will be made for the purpose of
paying the same and all expenses of this sale including attorney's
fees.
To the best information, knowledge and belief of the undersigned, the
property is presently in the possession of Joseph Lee Marshall.
The property will be sold as the property of said Joseph Lee Marshall,
and will be sold subject to all restrictions, liens, encumbrances,
easements and other matters of record, if any, including a life
estate in favor of Doris Marshall, to which the Deed to Secure Debt
is junior and inferior in terms of priority, and subject to any and
all unpaid taxes or assessments relating to the property.
