STATE OF GEORGIA COUNTY OF RICHMOND NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT This law firm is acting as a debt collector attempting to collect a debt. Any information obtained will be used for that purpose. On the 29th day of December 2014, John M. Cropper executed a Renewal Note ("Note") in the sum of $159,470.50, and made payable to Georgia Bank & Trust Company of Augusta, ("Georgia Bank"), said Note being secured by a Deed to Secure Debt (With Future Advance Clause) ("Deed") from John M. Cropper and Cynthia S. Cropper, dated May 27, 2014, conveying property described in Exhibit "A" attached, and recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Deed Book 01440, page 1953. Said Note was subsequently modified by Consent Judgment and Consent Judgment Agreement dated March 3, 2016 and filed in the Superior Court of Columbia County, Civil Action File No. 2016CV0173. Default has been made in the payment of installments. Georgia Bank declared the entire unpaid indebtedness due and payable in accordance with the terms of said Note, and the same has not been paid. The Deed provides that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Richmond County, Georgia, upon Georgia Bank first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the sheriff's advertisements are published, and where said property is located. NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Richmond County, Georgia, at public outcry on the first Tuesday in December 2016, between the legal hours of sale. Georgia Bank will convey title to the purchaser as attorney-in-fact for John M. Cropper and Cynthia S. Cropper. The money derived from the sale will be applied: first to the expenses of said sale; secondly, to the amount due on said Note; and the balance, if any, shall be paid to John M. Cropper and Cynthia S. Cropper. TERMS: Cash, subject to State and County ad valorem taxes or assessment and any federal tax liens of record. At the election of Grantee the premises or any part thereof may be sold in one parcel and as an entirety, or in such parcels, manner or order as Grantee in its sole discretion may elect, and one or more exercises of the powers herein granted shall not extinguish or exhaust the power unless the entire premises are sold or the secured indebtedness paid in full. Wilson Drive Augusta, Georgia 30909 706-860-9995 State Bar No. 129754 EXHIBIT "A" All that tract or parcel of land with improvements thereon, situate, lying and being in the City of Augusta, Richmond County, Georgia, on the Northwest corner of Gwinnett Street and Summer Street, fronting a distance of 158.96 feet, more or less, on the North Side of Gwinnett Street and extending back between approximately parallel lines a distance of 289 feet, more or less, along the Western right-of-way line of Summer Street, to a rear width of 158.6 feet, more or less and being known and designated as LOTS 19-26 as shown on a plat of lots comprising a part of the Estate of Mary Bouyer McKinley recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia in Realty Book 7-G, pages 124-125; reference is hereby made to said plat for a more complete and accurate description as to the metes, bounds and location of said property. ALSO, LESS and excluding that strip or parcel of land situate, lying and be in in the City of Augusta, Richmond County, Georgia, being rectangular in shape and located along the eastern boundary line of a rectangular strip of land which Steve Gurley quit claimed to The City of Augusta by instrument dated January 16, 1992 and recorded in Realty Reel 386, page 1811, Richmond County record, which strip f land is located north of Laney Walker Boulevard and west of Summer Street. The said rectangular tract of land has a northern boundary of 3.68 feet; an eastern boundary of 63.55 feet; a southern boundary of 3.68 feet and a western boundary line having a length of 63.55 feet. The northern boundary line is on a course of south 66 degrees 10 minutes 48 seconds east and the southern boundary is on a course of south 61 degrees 06 minutes 00 seconds west, with a plat of the contiguous rectangular parcel of land being attached to the above stated quit claim. Said property is the same as that more particularly shown and described in that Quit Claim Deed from Steve Gurley, et al to The City Council of Augusta, dated August 20, 1992, and recorded in said Clerk's Office in Realty Reel 395 at page 1102. The property herein conveyed being in same property conveyed to A.C.E. Management, Inc. from Steve Gurley by that certain Warranty Deed dated October 10, 2002, as recorded in aforesaid Clerk's Office in Realty Reel 816, page 2080. This being the same property as that conveyed to SunTrust Bank by Deed Under Power of Sale of Golakia Corporation dated October 2, 2012 which was recorded on October 4, 2012 in said Clerk's Office in Deed Book 1362, at page 2201. Said property being commonly known as 843 Laney Walker Boulevard, Augusta, Georgia 30901. Map and Parcel No. 059-2-109-01-0 ALSO, all that lot or parcel of land, with improvements thereon, situate, lying and being in the State of Georgia, County of Richmond, being known and designated as Lot 13, lock H, Section II-B, and Sand Ridge Subdivision, as shown on plat recorded in the Office of the Superior Court of Richmond County, Georgia, in Reel 237, pages 557-564. Reference is hereby made to said plat for a more complete and accurate description of said property hereby conveyed.
