STATE OF GEORGIA COUNTY OF RICHMOND NOTICE OF SALE UNDER POWER IN DEED TO SECURE DEBT This law firm is acting as a debt collector attempting to collect a debt. Any information obtained will be used for that purpose. On the 13th day of August 2013, John M. Cropper executed a Promissory Note ("Note") in the sum of $224,884.88, and made payable to Georgia Bank & Trust Company of Augusta, ("Georgia Bank"), said Note being secured by a Deed to Secure Debt and Assignment of Rents, dated June 22, 2006, conveying property described in Exhibit "A" attached, and recorded in the Office of the Clerk of Superior Court of Richmond County, Georgia, in Deed Book 01066, page 0182, a Deed to Secure Debt and Assignment of Rents dated April 12, 2007, and recorded in aforesaid Clerk's Office in Deed Book 01115, page 2393, and a Modification of Deed to Secure Debt dated August 13, 2013, and recorded in aforesaid Clerk's Office in Deed Book 01408, page 1635, hereinafter collectively referred to as ("Deeds"). Said Note was subsequently modified by Consent Judgment and Consent Judgment Agreement dated March 3, 2016 and filed in the Superior Court of Columbia County, Civil Action File No. 2016CV0173. Default has been made in the payment of installments. Georgia Bank declared the entire unpaid indebtedness due and payable in accordance with the terms of said Note, and the same has not been paid. The Deeds provide that when the Note secured thereby becomes due and is not paid, that said property may be sold before the Courthouse door of Richmond County, Georgia, upon Georgia Bank first giving notice of the place and terms of such sale (1) time a week for (4) weeks in the newspaper in which the sheriff's advertisements are published, and where said property is located. NOW THEREFORE, pursuant to the powers contained therein, the property will be sold before the Courthouse door in Richmond County, Georgia, at public outcry on the first Tuesday in December 2016, between the legal hours of sale. Georgia Bank will convey title to the purchaser as attorney-in-fact for John M. Cropper. The money derived from the sale will be applied: first to the expenses of said sale; secondly, to the amount due on said Note; and the balance, if any, shall be paid to John M. Cropper. TERMS: Cash, subject to State and County ad valorem taxes or assessment and any federal tax liens of record. This 6th day of December 2016. Reference is made to said plat for a more complete and accurate description as to metes, bounds and location of said property.
