NOTICE OF SALE UNDER POWER GEORGIA, RICHMOND COUNTY By virtue of Power of Sale contained in Deed to Secure Debt from DEBRAH L. MARKS, DONALD H. MARKS, and ELLA M. MARKS hereinafter Grantor(s), to SOUTHERN BANK, dated June 15, 2007, recorded in Deed Book 1127, Page 2344, and modified July 8, 2016, recorded in Book 1546, Page 445 in the Richmond County Records; said Deed to Secure Debt being given to secure a Note and Security Agreement in the original principal amount of $194,657.25; there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Richmond County, Georgia, within the legal hours of sale on Tuesday, December 6, 2016 the following described property: ALL THAT TRACT or parcel of land, located in Richmond County, Georgia, consisting of 3.213 acres as shown on a plat prepared Lee Ellen Carroll, dated December 31, 1983, by Jack D. Barker and Associates. Said property may be described as follows: Beginning at a point located on the right-of-way of Hephzibah McBean Road, approximately 707 feet West of the intersection of Hwy 25, and the Hephzibah McBean Road, and continuing back in a northerly direction 700 feet at an angular bearing of S31degrees - 36'20"W; thence turning West for a distance of 700 feet; thence going in an Easterly direction 200 feet, at an angular bearing of N58 degrees - 23"40"W, to the original point reference above. Said property is bordered on the South by the Hephzibah McBean Road and is bordered on all other sides by property now or formerly of Sewell. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed. Pursuant to O.C.G.A. Section 9-13-172.1 which allows for certain procedures regarding the rescission of judicial and non-judicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided immediately above. The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, nonpayment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees.
