STATE OF GEORGIA COUNTY OF GLYNN NOTICE UNDER POWER OF SALE On March 28, 2013, Green's Auto Repair, LLC executed a Note in the original principal amount of $28,000, payable to JANE CREDLE. Time was made the essence of the contract and the Note contained a provision for the payment of attorney's fees if collected by law or through an attorney at law. In order to secure the payment of said Note, Green's Auto Repair, LLC, executed and delivered to Jane Credle a Deed to Secure Debt, recorded in Deed Book 3137, Page 78, in the Office of the Clerk of Superior Court of Glynn County, Georgia, conveying the following described property: PARCEL 1: All those certain lots, tracts and parcels of land situate, lying and being in the City of Brunswick, in Glynn County, Georgia, as New Town Subdivision Lots Numbered 1893, 1894, 1895, 1899, and 1900. Reference is hereby made to the map and plan of said city for all purposes of description. PARCEL 2: All of those certain lots, tracts, or parcels of land situate, lying and being in the City of Brunswick, Glynn County, Georgia, described and identified according to the well known maps and the pan of said city as all of New Town Lots Numbers One Thousand Eight hundred and Ninety-One (1891) and One Thousand Eight Hundred and Ninety-Two (1892). Said Lot No. 1891 being the same tract of parcel of land described in the deed from Wright and Parker to Eliza Earle Wright and May Wright Parker, dated August 7, 1934, and recorded in Deed Book 4-M, Page 329, Glynn County records and said Lot No. 1892 being the same tract or parcel of land described in the deed from R.A. Gould, Trustee, to Eliza Earle Wright and May Parker, dated June 14, 1935 and recorded in deed Book 4-N, page 658, Glynn County records. The maps and plan of said city and said deeds are incorporated herein by reference. Street Address 1917, 1921 & 1923 Norwich Street & 900 J Street Because the said Green's Auto Repair, LLC defaulted in making payment of said Note, Jane Credle, pursuant to the provisions of said Note and the aforesaid Deed securing the same, has exercised her option and declared the entire balance due and collectible. Notice fixing the liability for attorney's fees has been given according to the law. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, easements, leases, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. Pursuant to O.C.G.A. 44-14-162.2 the name of the person or entity having the full authority to discuss negotiation, amendment or modification of the terms of the aforementioned indebtedness is: Jane Credle, 95 Dalonigei Court, Brevard, North Carolina 28712, telephone (828)883-4376. The property will be sold as the property of Green's Auto Repair, LLC who, to the best of the undersigned's knowledge and belief, is the party in possession. The said Deed contains a power of sale, authorizing the Grantee, as attorney in fact for Grantor therein, to sell the property conveyed thereby in order to satisfy said Note, as well as subsequent advances, after advertising the same once a week for four (4) weeks in the official gazette of said County, and in accordance with said power of sale and by virtue thereof, Jane Credle will sell the property above described at public outcry to the highest and best bidder for cash, on the first Tuesday in December at the place of public sales before the courthouse door in Glynn County, Georgia, and within the legal hours of sale. The proceeds of the sale will be used as follows: (a) to pay the expenses of said sale; (b) to pay the sums secured by said Deed; and (c) the balance according to law.
