NOTICE OF SALE UNDER POWER
GEORGIA, CHATTOOGA COUNTY
This is an attempt to collect a debt. Any information obtained will be used for that purpose.
Under and by virtue of the Power of Sale contained in a Security Deed given by Rhonda Espy N/K/A Rhonda D. Lively to Mortgage Electronic Registration Systems inc as nominee for Taylor, Bean & Whitaker Mortgage Corp., dated 02/07/2006, recorded in Deed Book 494, Page 481, Chattooga County, Georgia records, as last transferred to U.S. Bank National Association, As Trustee For TBW Mortgage-Backed Trust Series 2006-2, TBW Mortgage-Backed Pass-Through Certificates, Series 2006-2 by assignment recorded or to be recorded in the Chattooga County, Georgia records conveying the after-described property to secure a Note in the original principal amount of Sixty-Four Thousand and 00/100 DOLLARS ($64,000.00), with interest thereon as set forth therein, there will be sold at public outcry to the highest bidder for cash at the usual place for conducting Sheriff's sales in Chattooga County, Georgia, within the legal hours of sale on the first Tuesday in December 2016, the following described property:
Tract One:
All that tract or parcel of land lying and being in Land Lots 23 and 14 in the 6th District and 4th Section of the State of Georgia, County of Chattooga and more particularly described as follows:
Lots numbered one (1) and two (2) in Block "D" in Taylor-Farrar addition to the City of Summerville, Georgia, as per plat on record in the Office of the Clerk of the Superior Court of Chattooga County, Georgia and being the same property conveyed to Estera C. Fulmer and Robert W. Fulmer by Miss Edna Thomas in a deed dated February 10, 1940, said deed being recorded in Deed Book 26, page 133 in the Office of the Clerk of the Superior Court of Chattooga County, Georgia.
Tract two:
All that tract or parcel of land lying and being in Land Lots 23 and 14 in the 6th District and 4th Section of the State of Georgia, County of Chattooga and more particularly described as follows:
Beginning at a point on the northwest corner of property now owned by Robert W. and Estera C. Fulmer, the same lots numbered one(1) and two (2) in Block "D" in the Taylor-Farrar addition to the City of Summerville, Georgia, as per Plat of Record in the Office of the Clerk of the Superior Court of Chattooga County, Georgia; thence westerly a distance of 25 feet in a straight line as an extension of the east-west lines of the northerly side of said lots numbered one (1) and two (2); thence easterly a distance of 25 feet to the southwest corner of said property of Robert W. and Estera C. Fulmer; thence to beginning point.
Same being a strip of land 25 feet in width of the property of Mrs. B.E. Neal and immediately west of the property of Robert W. and Estera C. Fulmer.
This being the same property conveyed to Robert W. Fulmer and Estera C. Fulmer in a deed dated April 18, 1957 and recorded in Deed Book 68, page 308, in the Office of the Clerk of the Superior Court of Chattooga County, Georgia.

The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Ocwen Loan Servicing, LLC, 1661 Worthington Road, Suite 100, West Palm Beach, FL 33409, 561-682-8000. Please understand that the secured creditor is not required by law to negotiate, amend, or modify the terms of the mortgage instrument.
To the best knowledge and belief of the undersigned, the parties in possession of the property are Rhonda Espy N/K/A Rhonda D. Lively or a tenant or tenants.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the security deed.
