NOTICE OF SALE UNDER POWER
State Of Georgia, County Of Chattooga
Under and by virtue of the Power of Sale contained in a Deed to Secure Debt given by David A. Lowe to Mortgage Electronic Registration Systems, INC. ("MERS") As Nominee For Firstbank, dated 08/29/2014, and Recorded on 09/09/2014 as Book No. 00632 and Page No. 169182, Chattooga County, Georgia records, as last assigned to J.P. Morgan Mortgage Acquisition Corp. (the Secured Creditor), by assignment, conveying the afterdescribed property to secure a Note of even date in the original principal amount of $98,422.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash at the Chattooga County Courthouse within the legal hours of sale on the first Tuesday in January, 2017, the following described property:
All that tract or parcel of land lying and being in Land Lot No. 140 in the 6th District and 4th Section of Chattooga County, Georgia and being more particularly described in accordance with a plat of survey by Carl N. Morrison, Georgia Registered Land Surveyor No. 1686, dated July 23, 2014 Drawing Mary2.dwg, as follows:
To find the point of beginning, start at the southeast corner of Land Lot No. 140; thence along the south line of said land lot, north 86 degrees 13 minutes 04 seconds west, a distance of 987,40 feet; thence north 23 degrees 08 minutes 36 seconds east, a distance of 208.85 feet; thence north 76 degrees 50 minutes 52 seconds west, a distance of 178.54 feet to a rod found in the eastern right of way line of Thomas Road; thence along said right of way line the following courses and distances: north 33 degrees 43 minutes 39 seconds east, 42.16 feet; north 33 degrees 26 minutes 20 seconds east, 56.18 feet; north 34 degrees 12 minutes 52 seconds east, 173.56 feet; north 33 degrees 36 minutes 32 seconds east, 26.70 feet to the true point of beginning; thence continuing along the east right of way line of Thomas Road the following calls and distances: north 34 degrees 32 minutes 26 seconds east, 50.11 feet; north 35 degrees 17 minutes 15 seconds east, 88.08 feet; north 36 degrees 48 minutes 56 seconds east, 72.41 feet; north 38 degrees 40 minutes 09 seconds east, 52.62 feet; north 45 degrees 28 minutes 48 seconds east, 13.25 feet; thence south 57 degrees 01 minutes 57 seconds east, a distance of 322.58 feet; thence south 86 degrees 13 minutes 30 seconds east, 53.24 feet; thence south 25 degrees 08 minutes 12 seconds west, 125.51 feet; thence south 72 degrees 00 minutes 11 seconds west, a distance of 158.37 feet; thence north 67 degrees 08 minutes 36 seconds west, a distance of 309.11 feet to the point of beginning.

The debt secured by said Deed to Secure Debt has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Deed to Secure Debt. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Deed to Secure Debt and by law, including attorneys fees (notice of intent to collect attorneys fees having been given).
To the best knowledge and belief of the undersigned, the party/parties in possession of the subject property known as 640 THOMAS RD, TRION, GEORGIA 30753 is/are: David A. Lowe or tenant/tenants.
Said property will be sold subject to (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) all matters of record superior to the Deed to Secure Debt first set out above, including, but not limited to, assessments, liens, encumbrances, zoning ordinances, easements, restrictions, covenants, etc.
The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the security deed.
Pursuant to O.C.G.A. Section 913172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until
final confirmation and audit of the status of the loan as provided in the preceding paragraph.
