UNDER POWER
STATE OF GEORGIA
COUNTY OF GWINNETT
By virtue of the Power of Sale contained in the Security Deed from GLENN T. KNIGHT and ANNA B. KNIGHT (collectively, Grantor) to IRONSTONE BANK (Ironstone), dated March 8, 2007, recorded in Deed Book 48436, Page 184, in the deed records of Gwinnett County, Georgia (the Security Deed), said Security Deed being given to secure:
(a) the obligations of Grantor to IronStone as set forth in an Equityline Agreement from Grantor to IronStone, dated March 8, 2007, which evidences an indebtedness in the amount of Forty Thousand and No/100 Dollars ($40,000.00), with interest as specified therein (the Note); and
(b) such other indebtedness of Grantor as is defined in the Security Deed;
FIRST-CITIZENS BANK & TRUST COMPANY being the successor by merger to IronStone Bank;
There will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Gwinnett County, Georgia, within the legal hours of sale on the first Tuesday in December, 2016, the following described property:
ALL THAT TRACT OR PARCEL OF LAND lying and being in Land Lot 91 of the 5th District, Gwinnett County, Georgia, being Lot 68, Block B, Haynes Preserve Subdivision, Unit II, as per Plat recorded in Plat Book 87, Page 188, Gwinnett County, Georgia records, said Plat being incorporated herein and made a part by this reference.
Said property being commonly known as 3040 Haynes Club Circle, Grayson, Georgia.
The indebtedness secured by the Note has been and is hereby declared due because of the failure to comply with the terms and conditions contained in the Note and Security Deed. The indebtedness remaining in default, the sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness secured by the Security Deed, accrued interest and expenses of the sale and all other payments provided for under the Security Deed, including attorneys fees as provided in the Note and Security Deed, notice of intention to collect attorneys fees having been given as provided by law; and the remainder, if any, shall be applied as provided by law.
To the best of the undersigneds knowledge and belief, the current owner of the property is Anna B. Kirkland, and the party in possession of the property is Anna B. Kirkland or tenants of Anna B. Kirkland.
Said property will be sold as the property of Grantor subject to all unpaid property taxes, assessments, restrictions, restrictive covenants, rights of way, and easements of record, if any, and subject to that certain Security Deed, dated June 23, 2005, from Grantor to Mortgage Electronic Registration Systems, Inc. as nominee for SunTrust Mortgage, Inc. dba BancMortgage, recorded in Deed Book 43357, Page 10, Gwinnett County, Georgia records, securing payment of indebtedness in the original principal amount of $144,900.00, as assigned to SunTrust Mortgage, Inc. by Corporate Assignment of Security Deed, dated May 5, 2016, recorded in Deed Book 54276, Page 872, aforesaid records.
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Security Deed.
