CLASS:007 NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF COWETA Because of a default under the terms of the Security Deed executed by Grady L Bethea and Keri T Bethea to Mortgage Electronic Registration Systems, Inc. as nominee for Northstar Mortgage Group, L.L.C., its successors and assigns dated May 30, 2006, and recorded in Deed Book 2975, Page 814, Coweta County Records, said Security Deed having been last sold, assigned, transferred and conveyed to Ditech Financial, LLC, securing a Note in the original principal amount of $52,248.00, the holder thereof pursuant to said Deed and Note thereby secured has declared the entire amount of said indebtedness due and payable and, pursuant to the power of sale contained in said Deed, will on the first Tuesday, December 6, 2016, during the legal hours of sale, before the Courthouse door in said County, sell at public outcry to the highest bidder for cash, the property described in said Deed, to-wit: All that Tract or Parcel of Land Lying and being located in Land Lot 26, Land District 5, City of Newnan, Coweta County, Georgia and being more particularly described as follows: To find the true point of beginning, commence at the intersection of the North 50' R/W of Spring Street and the East 50' R/W of Melson Street and run thence East along the said North 50' R/W of Spring Street for a distance of 187.00' to a 3/8" rerod found and the true point of beginning of the property herein described: From said true Point of Beginning Run Thence North 33 degrees 10 minutes 22 seconds West for a distance of 77.29 feet to a 3/8" rerod found; Thence North 00 degrees 58 minutes 18 seconds East for a distance of 50.55 feet to a 3/8" rerod found; Thence South 84 degrees 29 minutes 46 seconds East for a distance of 74.57 feet to a 3/8" rerod found; Thence South 35 degrees 07 minutes 39 seconds East for a distance of 26.04 feet to a point located on the West Bank of a Branch; Thence South 31 degrees 46 minutes 48 seconds East for a distance of 47.44 feet along West Bank of a Branch to a point; Thence South 41 degrees 31 minutes 35 seconds East for a distance of 61.85 feet along said West Bank of a Branch to the North 50' R/W of Spring Street; Thence South 89 degrees 55 minutes 40 seconds West for a distance of 113.76 feet along said North 50' R/W of Spring Street to a 3/8" rerod found and the True Point of Beginning. This property being the same property shown in the Final Order, recorded in Deed Book 4356, Page 634, Coweta County, Georgia records. Said property is known as 141 Spring Street, Newnan, GA 30263, together with all fixtures and personal property attached to and constituting a part of said property, if any. Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, whether or not now due and payable), the right of redemption of any taxing authority, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The proceeds of said sale will be applied to the payment of said indebtedness and all expenses of said sale as provided in said Deed, and the balance, if any, will be distributed as provided by law.
